The person who pulled the files said there was a 1072 and 1080 contracts. They said the 1072 had a due date of 3/30 and the 1080 had a due date of 4/27. Just trying to get a clarification
if there are two bids and if we have the due dates accurate to return our bid?
It looks like the pre-bid meeting was changed to April 3rd. Will a notice be released prior to the meeting to let us know the details for location and time?
Do we need to submit any intention to bid or bidder qualification forms ahead of time? Some of the documents were a bit confusing and seemed to only apply to MBE/WBE firms, so I wanted
to make sure I was not overlooking anything.
Is this project Prevailing Wage and can you confirm that the Contractor and Subcontractors need to have a City of Waterloo Affirmative Action Plan?
Can this project file be obtained through a ZIP file access?
Do you have the fiber plans in a KMZ format? It is much easier for us to analyze and plan in that format?
On the Pedestals on line item number 223, it lists quantity but not size. Can you help?

The FTTP network will pass all residents and businesses of Waterloo that includes 390.54 miles Question: (Tab sheet total is 608.86 miles) of underground construction to pass roughly
29,400 premises.
Phasing Work Orders Plans: Question: (is this proposed work under the same contract?)
Contractor shall utilize sound judgement when completing underground utility excavations and installations. No guess work as to where existing utilities are located. All practical means
necessary shall be utilized to locate existing utilities to include locates, soft digs and spot holes, and ground penetrating radar shall be considered to avoid conflicts. Contractor’s
pricing shall include these in their pricing as a cost of doing business. Question: (is the City of Waterloo locating there municipal utilities?)
Will it be acceptable to attend the pre-bid meeting via the Zoom option only, or is in-person attendance required?
What are the sizes and specs for the following items listed below? Ped
NEMA Enclosure
A 100% Performance and Payment bond is required for this project, can this 100% requirement be eliminated or significantly reduced?
The payment of contractor invoices is dependent upon Engineer and monthly City Council approval. Can invoices be submitted weekly based upon production completed and approved by the
Engineer on Net30 terms based upon the invoice date?
Can the Maintenance Bond amount be reduced to 10% of the contract amount?
Can the 50% self-performance requirement be eliminated?
Please specify what is required for the contractor under the Maintenance Bond. Will the contractor be required to keep a crew available to repair third party damages and is this billable
to the City for the duration of the Maintenance Bond?
The Contract Award is scheduled for May 3rd and Commence Construction is scheduled for June 5th. This does not provide enough lead time for material ordering, receipt, and staging.
Please clarify what you mean by ‘Commence Construction’. With respect to the requirement to start work within 5 days of Notice to Proceed, please explain this process given the need
to order materials, permitting, licensing, etc.…
Are material lead times a valid delay that will be considered for extension of the contract?
It is impossible to determine what is Cobble and Rock Bore prior to construction. Will the City add an adder price for these items?
Due to the unknown nature of permitting fees, will the contractor be able to pass the cost for permitting fees on to the City?
Attachment C refers to both Dry and Gel-filled Fiber. Will the requirement be for Dry or Gel-filled Fiber? We suggest that Gel-filled be used for anything that is buried
Attachment C, 2.4. Will the Contractor be responsible to design the Cut-Sheets, or will the Engineer provide the Cut Sheets and the Contractor turn them back in as ‘As-Builts’? We believe
that the design of Cut-Sheets should be provided by the Engineer.
Other than Concrete and Traffic Control, we see no MBE or WBE owned businesses that can perform the work required under this contract. We doubt we will be able to meet the MBE/WBE requirements
of the contract. Is that acceptable to the City?
We only pay sales tax on material and not labor. How does the City want to handle sales tax on materials purchased out of state and what procedures are you requiring to document sales
tax?
Many of the pages of the RFP refer to specification not normally used for Telecommunications projects. These pages include those in the Supplemental Specifications to the SUDAS Specifications
section, General Specifications for Construction section, and Supplemental General Specifications for Construction. Can these be modified to meet the needs of this project? Example:
Section D item 1 ‘Order of Completion – Use of Completed Portions’
Staking of ROWs should not be required for Fiber Construction projects. If surveying is required, will this be billable back to the City?
Contractor has 3 days to correct anything identified by the City or the City can perform the work and charge the contractor. 3 Days is not enough time to get the locates to be able
to perform the corrective work. Can this requirement be modified?
Can the contract and related bonds be broken out by Phase?
Bond Form – the contract requires a separate 100% maintenance bond to be provided prior to final payment, yet the owner’s bond form is a combined performance/payment/maintenance bond.
How will this work?
What size pedestals is the owner wanting (8” or 10”)?
Are the fiber trays needed open or closed like a FiberBox?
What size peds and what is needed for inside them?
The FOSC-D case includes a slack basket, but you also have a line item for the slack basket; do you want this doubled up or just priced out separately?
What type of splitter cabinets are you wanting (Clearfield, etc.)?
For the NEMA Enclosure what type are you wanting (type 1, 4, etc.)?
Also, do you have more detail/drawings of where the 6" and 8" steel casings are being used?
Can we use vendors and suppliers as part of the MBE/WBE requirements? And can we use subs/vendors outside of the Waterloo area?
Steel Casing-What is the required wall thickness required by the RR’s
FDH Cabinets, it was mentioned in the meeting that Clearfield was the preferred Mfg. of the FDH Cabinets, if we could get a Model number that would be great
Pedestals- In the meeting it was mentioned that Charles Industries would be the preferred Ped. Provider, but as you know they make so many sizes and styles if you could get us the Part
Number(s) and Sizes that would be greatly appreciated.
FOSC Cases, I just want to clarify in the RFP it states the sizes of the HH’s and all are to have a 24” Depth, with going with all FOSC D cases and being very familiar with splicing
I just want to verify that Engineering has considered with CommScope that the D Cases will fit in the Splice location with the appropriate HH Size to accommodate the Case, Tail, and
Slack. In my Experience 24x36x24 wont accommodate a D case but a 24x36x36 will ( Just speaking from experience)
Are we able to work Saturdays/weekends?
WBE/MBE requirement. Can vendor/suppliers be apart of this requirement?
Can the contractor hire outside of Waterloo for sub-contractor and to also meet the WBE/MBE requirement?
Will there be reasonable extensions for variable out of the contractors control. Does this take in a count for obtaining materials to start?
Will this be federal wages or Davis Bacon pricing?
How will permitting a ROW process will go and who will be responsible for what?
Railroad and Army Corp permits take some time for approvals and fees. Why wouldn't the city submit the permits? Is this a state code or railroad requirements?
Who's name will the railroad permits be in? There are usually annual fees associated with the railroads when you cross it?
Who are the Railroad companies in Waterloo
If the permit is in the contractors name that the only right of access that the city has to have that utility under the railroad, essentially the city doesn't have a permit to have the
utilities under the railroad?
If 100% of the materials are purchased upfront will 80% of the materials be reimbursed when the project starts?
Are permit fees will be paid as a pass-through?
In the event the contractors submits the permits and revisions are needed, does this get pushed back for re-engineering and back to contractors to resubmit.
I sent over a list of 16 question the other day, will those be answered or should I bring those out in this call?
Traffic control cost should be built those into the units on the cost sheet or separately?
Due to the size of the project will there be consideration to using more that 50% of sub-contractors for the project unless pre-approved? Example using 75% labor as subs.
Can we call out how many FOSC A,B D cases are needed?
Will the 1X32 splitters be rack mounted. 1X64 splitters will be located in the FDH cabinets? Also, clarify what type of rack is required?
Are the contractors responsible to provide splice trays? The FOCS case no longer come with them but there's a line item to quote them out. A little confusing.
On the quantities not called put should we provide a price or ignore it?
Can more specific details be provided in the notes for the deep bore/water crossings.
Mule tape: Which size is acceptable - 1250 or 1800 lbs.
Fiber: Can we substitute dia-electric cable for armored cable? You want to use #12 tracer wire and dialectic cable?
Is there a requirement for the wall thickest for the steel casing?
Will the contractors be allowed to work on Saturday's?
Substantial completion does this included spliced and tested
Scheduling of the project – not sure if this is done by Phase or geography but will be helpful to understand how the project is scheduled out to completion
How would the elimination of the Division 2 work impact the project?
Can you give the value of each phase called out in the specs (% of the total )
When can we expect the Q&A document to be published for all attendees?
Michels respectfully requests an extension of the due date to April 27, 2023. Please advise if this is possible.
For additional context, we are requesting the extension due to the magnitude of the project, and due to the short time between the current expected date for responses to questions (4/10)
and the date we would need to send out the proposal (4/11) in order for it to reach you by the due date (4/13).
We have also received more questions in regard to the following items: Are there any more specs/details for these items? 288F Pad mounted FDH Splitter Cabinet, 432F Pad mounted FDH Splitter
Cabinet, 1x32 Splitter, 1x64 Splitter, 288 port rack mount panel, Wall Mount Fiber Enclosure, 7ft Rack for patch panels

Contract 1080 is the correct project and the dates will be updated and sent out in the Notice to Bidders.
The pre-bid meeting is/was March 30th. Yes, a notice will be sent out
No intention to bid or bidder qualification forms is required ahead of time. A mandatory pre-bid meeting is required to attend. The bid does have requirements pertaining to the MBE/WBE
and are required to be submitted with the bid proposal.
The prime contractor is required to have an AAP. Subcontractors are not.

CONTRACT NO. 1080 RFP QUESTIONS
FRF funds committed by City of Waterloo must be obligated (committed under contract) by December 31, 2024. Portions of the project funded by FRF will have to be completed before Dec.
31, 2026.
Project dues date is 12/31/2026, which includes division 1 & 2 work. This is a three year construction window. If division 2 is pulled for the grant, there will be a separate contract
obligation for the project.
Per the Project Manual: The City has active grant applications into federal funding agencies for portions of the backbone only (Division 2 work). In the event of a grant award, the
City reserves the right to remove the Division 2 work from this Contract, with a reduction in fee to the Contractor equivalent to the bid price associated with the Division 2 work.
The City anticipates that a decision regarding the Division 2 work will be made on or before June 1, 2023.
Per the MBE/WBE program, the prime contractor is required to provide a good faith effort to hire MBE/WBEs. If the prime contractor is unable to meet the requirements, they should be
able to provide documentation on their efforts.
ROW permits will be submitted to the City. The City has reviewed the plans. We anticipate the plots to be submitted on an FDH level to the City. All work will be in the ROW with no easement
work.

The City of Waterloo and the Municipal Telecommunication Utility will assist and provide all approved marketing content/material for distribution to the contactors. Contractor will be
responsible to providing these materials in areas of active construction.
The FTTP build is 390 miles and the BB build is 115 miles. The total tab is 525 miles. The additional footage on the total tab take into account ditch variance.

Iowa Code sec. 573.2(1) states: “Contracts for the construction of a public improvement shall, when the contract price equals or exceeds twenty-five thousand dollars, be accompanied
by a bond, with surety, conditioned for the faithful performance of the contract, and for the fulfillment of other requirements as provided by law.” The bond is mandatory under Iowa
law.
Monthly invoice is preferred. JK: On Engineering Department managed projects, we pay every 2 weeks. The engineers approve the pay estimates and then are sent on to council to be approved
with all bills submitted by all departments.
No. The maintenance bond cover 100% of the cost of the improvements. This is standard for public improvement projects in Iowa.
No. Consideration would be given to a 35% in-house vs 65% sub-contractor labor ratio.
The maintenance bond is intended to cover material defects or construction defects. It is not for the contractor to make repairs for third party damage. The city may change order a
third party damage repair but the contractor would be paid for that work.
Commence of Construction - crews are mobilized onsite and ready to begin construction. We expect mobilization to begin to occur after contract signing with actual construction efforts
commencing within 30-days.
Yes, material lead times are a valid delay, and should be communicated within your bid regarding expectations of timing, and how this affects the contractors ability to mobilize timely.
Please add a rock unit to your bid in the event rock is encountered. If there are changed conditions, the contractor can apply for a change order.

We would take it into consideration depending on the suppliers with city approval. As soon as the contractor is selected the city would like approved materials to be ordered ASAP. If

Magellan will prepare the permits for contractors to submit as the permits are required to be in the selected name performing the work.
The city is not performing the work. The contractor will be performing the work, thus need to submit under their name. JK: Railroad will not accept permits accept for the contractor
doing the work. Thus the city can not apply for ahead of time. Corp of Engineers permits Magellan is working and coordinating but there will be some that the contractor will be responsible
for to sign and be a party too for crossing levies and thing like that. DOT/ROW permits has to be completed by the contractor. Railroad and state of Iowa that the contractor required
to apply themselves.
The contractor and the Owner (City) names with certificate of insurance provided on the permits. There is a permit for doing the working but not an annual fee.

All FOSC D for the project. Attachment B Labor and Material list quantities needed.
We will use 1X64 splitters for everything in conjunction with the cabinets which the splitters will be placed. 1X32 splitters needs to be quoted and those will also be placed in the
cabinets. Racks are not associated with the cabinets. The rack are associated with the backbone and not the FTTP portion of the project.
The intention would be that the contractor with purchase the splice tray with this line item that would be paid for.

No. We do not want to change the cable specification, please use dia-electric and tracer wire. The cable specifications are called in attachment C for allowable fiber to be used for
the project. Please refer to the typical on the engineering drawings. If the contractor can provide cost effectiveness of armored cable it will be considered.

Yes. Splicing and Testing
The project will be scheduled and managed through task orders for each phase of the project through completion.
Division 2 will require a separate solicitation for bid if the City's grant application is approved for funding.
A rough breakout cost per phase can be provided.
Once all the final submission of questions are submitted by April 5th, 2023, the deadline to have those responses are due back April 10th to be published. If we are able to notify all
attendees prior to April 10th, I will notify everyone at that time.
The city will provide an addendum with new dates on when bids are due.
