A RESOLUTION GRANTING PERMISSION TO ALERT L. =RI
AND AUTHORIZING CEISTSZRUCTION OF A TEMPORARY ASPHALT
DRIVEWAY AT 3930 CEDAR TERRACE DRIVE. 'WATERLOO, ma.
IRRESPECTIVE OF A LATER OFFICIAL GRADE.
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA: That,
WHEREAS, Albert L. Jensen
has made written application to the City Council asking that jle
be authorized and permitted to construct one temporary asphalt driveway at
3930 Cedar Terrace Drive
without respect to a permanent
sidewalk grade when and if the same may be subsequently set on unplatted Wloo
West Sely 140 ft in even width of the fol part E 1 NE sec 18 T 88 R 12 com at a pt in
SWly line of Waterloo -LaPorte City Rd which is 431.97 ft NWly of ft in said rd which is
165 ft due W of E line of said Sec th SWly at rt ang with said Rd 317.6 ft to NEly line of
rt of way of e K & P RR th NWly along NEly line of rtof way 212.75 ft th NEly along a line
which is rt angs with said Rd .546. z rt to sway tine of salt Rd th SEly along Sally line of
said Rd 200 ft to pt of beg
known as 3930 Cedar Terrace Drive ;
and
WHEREAS, it is the sense of the Council of the City of Waterloo, Iowa,
that said request should be granted, now, therefore,
BE IT FURTHER RESOLVED that permission is hereby granted to
Albert L. Jensen to
•
construct one temporary asphalt driveway at 3930 Cedar Terrace Drive
in accordance with the existing contour of the abutting land with the
subjective understanding and agreement between the City of Waterloo,
Iowa, and the said Albert L. Jensen
that, should at a later date a permanent formal grade be established for
sidewalk purposes or otherwise, that the said
Albert L. Jensen will immediately thereafter,
and at his own expense, remove all or whatever portion of
temporary asphalt driveway be may have constructed, and re-
build or reconstruct the same in accordance with the permanent grade
as may hereafter be set and established, the work to be done under the
supervision of the City Engineer.
BE IT FURTHER RESOLVED, that the City Clerk is authorized and direct-
ed to forward a certified copy of this resolution to the Black Hawk
County Recorder for recording and the Black Hawk County Auditor for
filing in order that this said action may become a matter of official
County Record.
