RESOLUTION GRANTING PERMISSION TO CINDY
BRAATZ FOR A WAIVER FOR AN ASPHALT DRIVEWAY
TO BE LOCATED AT 277 NORTH HACKETT ROAD, AND
AUTHORIZING CONSTRUCTION OF AN ASPHALT
DRIVEWAY AND PLACING A DRIVEWAY OR SIDEWALK
ON CITY RIGHT-OF-WAY ON AN UNIMPROVED STREET.
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA:
WHEREAS, the City Engineer has made written application to
the City Council asking that Cindy Braatz be authorized and
permitted to construct an asphalt driveway and place a driveway
or sidewalk on city right-of-way on an unimproved street to be
located at 277 North Hackett Road, and legally described as
follows:
and
The East 100 feet in even width of that part of Lot No.
60 in Auditors Whitney Road Plat in Section 17-89-13 in
Black Hawk County, Iowa, bounded as follows:
Beginning at a point on the East line of said Lot which
is 357 feet North of the Southeasterly corner of said
Lot; thence West parallel with the South line of said
Lot 177.75 feet; thence North parallel with the East
line of said Lot to the Southerly line of the road as
established by Deeds 55 LD 559 and 96 TLD 98; thence
Southeasterly along the Southerly line of said road to
the East line of said Lot; thence South along the East
line of said Lot to the point of beginning; except that
part described as commencing at a point on the East
line of said Lot which is 357 feet North of the
Southeasterly corner of said Lot; thence West parallel
with the South line of said Lot 100.0 feet; thence
North parallel with the East line of said Lot 76.29
feet to the point of beginning of said exception;
thence continuing North and parallel with the said East
line 62.01 feet to the Northerly line of said Lot as
established by Deeds 55 LD 559 and 96 TLD 98; thence
Southeasterly 9.87 feet along the North line of said
established Lot; thence Southwesterly 58.79 feet to the
point of beginning of said exception.
That part of Lot No. 60 in Auditors Whitney Road Plat
in Section 17-89-13 in Black Hawk County, Iowa, bounded
as follows:
Commencing at a point on the East line of said Lot
which is 357 feet North of the Southeasterly corner of
said Lot; thence West parallel with the South line of
said Lot 100.0 feet to the point of beginning; thence
continuing West 11.87 feet; thence Northeasterly 77.03
feet to the point of intersection with a line extended
North and parallel with the East line of said Lot from
the point of beginning, being 76.29 feet North of the
point of beginning; thence South and parallel with the
East line of said Lot a distance of 76.29 feet to the
point of beginning, all in the City of Waterloo, Black
Hawk County, Iowa;

WHEREAS, it is the sense of the Council of the City of
Waterloo, Iowa, that said request should be granted.
NOW, THEREFORE, BE IT FURTHER RESOLVED that permission is
hereby granted to Cindy Braatz to construct an asphalt driveway
and place a driveway or sidewalk on city right-of-way on an
unimproved street to be located at 277 North Hackett Road,
subject to the following conditions:
1. Work to be performed by an approved and bonded
contractor.
2. A permit is to be obtained from the office of the City
Engineer prior to construction.
3. All work shall be performed under the supervision of
the City Engineer and at no cost to the City of
Waterloo.
BE IT FURTHER RESOLVED that the City Clerk is authorized and
directed to forward a certified copy of this resolution to the
Black Hawk County Recorder for recording and the Black Hawk
County Auditor for filing in order that this said action may
become a matter of official County Record.
