RESOLUTION NO. 2023-110
RESOLUTION APPROVING THE REQUEST BY FRIENDS OF
FAITH RETIREMENT HOMES, INC., (FRIENDSHIP
VILLAGE) TO DEDICATE A 50-FOOT SANITARY SEWER
EASEMENT AND APPROVE THE SANITARY SEWER
EASEMENT AND ENCROACHMENT AGREEMENT", AND
AUTHORIZING THE MAYOR AND CITY CLERK TO
EXECUTE SAID DOCUMENT.
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA, that
the request of Friends of Faith Retirement Homes, Inc., (Friendship Village) to dedicate a 50-foot
sanitary sewer easement, dated February 20, 2023, by and between Friends of Faith Retirement
Homes, Inc., (Friendship Village) and the City of Waterloo, Iowa, in conjunction with
construction of a pool and to allow for the maintenance of the sanitary sewer on said easement
without disrupting the pool that would be built over the sanitary sewer line, and legally described
as follows:
AN EASEMENT FOR SANITARY SEWER PURPOSES OVER, UNDER AND
ACROSS THAT PART OF THE SOUTHWEST QUARTER (SW 1/4) OF
SECTION THREE (03), TOWNSHIP EIGHTY-EIGHT NORTH (T88N),
RANGE THIRTEEN WEST (R13W), OF THE FIFTH PRINCIPAL
MERIDIAN, AND THAT PART OF TRACT A AND TRACT B,
SOUTHBROOKE, AND THAT PART OF LOT TWENTY-SIX (26),
BROOKERIDGE, ALL IN WATERLOO, BLACK HAWK COUNTY, IOWA.
SAID EASEMENT IS FIFTY (50.00) FEET WIDE LYING TWENTY FIVE
(25.00) FEET ON EACH SIDE OF THE FOLLOWING DESCRIBED
CENTERLINE, WHICH IS THE CURRENT LOCATION OF AN EIGHTEEN
(18) INCH SANITARY SEWER LINE:
COMMENCING AT THE NORTHEAST CORNER OF LOT FORTY-TWO (42)
SOUTHAVEN ADDITION; THENCE S58°15'28"E NINE HUNDRED
TWENTY-SIX AND TWENTY-THREE HUNDREDTHS (926.23) FEET
ALONG THE SOUTH RIGHT-OF-WAY LINE OF PARK LANE TO THE
POINT OF BEGINNING;
THENCE S27016'32"W TWO HUNDRED FORTY-TWO AND SIXTY-SEVEN
HUNDREDTHS (242.67) FEET;
THENCE S54059'58"W THREE HUNDRED NINETEEN AND FORTY-FIVE
HUNDREDTHS (319.45) FEET;
THENCE S57023'59"W TWO HUNDRED TWO AND SIXTY-TWO
HUNDREDTHS (202.62) FEET; THENCE S41050'28"W TWO HUNDRED
SEVENTY-ONE AND FIVE HUNDREDTHS (271.05) FEET; THENCE
S89036'46"W FIFTY-FIVE (55.00) FEET TO THE NORTHEAST RIGHT-OF-
WAY LINE OF FAIRLANE AVENUE AND TO THE POINT OF
TERMINATION OF AFORESAID SANITARY SEWER EASEMENT
CONTAINING 1.25 ACRES.
THE SIDELINES OF SAID EASEMENT SHALL BE LENGTHENED AND
/OR SHORTENED TO TERMINATE AT SAID NORTHEAST RIGHT-OF-
WAY LINE, THE SOUTHEAST RIGHT-OF-WAY LINE OF SAID FAIRLANE
AVENUE, AFORESAID SOUTH RIGHT-OF-WAY LINE OF PARK LANE
AND AS NEEDED TO PROVIDE A CONTINUOUS STRIP,
is hereby approved and the Mayor and City Clerk are authorized and directed to execute said

document on behalf of the City of Waterloo.
