RESOLUTION NO. 2023-229
RESOLUTION APPROVING REQUEST OF ROGER WOODEN
FOR A WAIVER FOR A CONCRETE DRIVEWAY, LOCATED
AT 1421 DENVER STREET, WITH THE ELIMINATION OF
THE SIDEWALK SECTION DUE TO INABILITY TO MEET
GRADE REQUIREMENT.
WHEREAS, the City Engineer has made written application to the City Council asking
that Roger Wooden, be authorized and permitted to construct a concrete driveway, with the
elimination of the sidewalk section due to the inability to meet grade requirements, located at
1421 Denver Street, and legally described as follows:
THAT PART OF LOT NO. THIRTY-ONE (31) IN "AUDITOR FRANCIS'
REITZEL PLAT", IN THE CITY OF WATERLOO, BLACK HAWK COUNTY,
IOWA, LYING WITHIN THE FOLLOWING DESCRIBED BOUNDARIES:
COMMENCING AT A POINT WHICH IS ONE HUNDRED EIGHTY (180)
FEET SOUTH OF A POINT WHICH IS THIRTY (30) FEET EAST OF THE
NORTHWEST COMER OF SAID LOT; RUNNING THENCE SOUTH ALONG
A LINE WHICH IS THIRTY (30) FEET EAST OF AND PARALLEL WITH
THE WEST LINE OF SAID LOT A DISTANCE OF SIXTY ( 60) FEET TO A
POINT WHICH IS NINETY-ONE AND NINETY-FIVE HUNDREDTHS
(91.95) FEET NORTH OF THE SOUTH LINE OF SAID LOT; RUNNING
THENCE EAST A DISTANCE OF ONE HUNDRED FORTY-EIGHT AND
EIGHTY-FIVE HUNDREDTHS (148.85) FEET TO A POINT ON THE WEST
LINE OF THE EAST ONE HUNDRED FORTY (140) FEET OF SAID LOT
WHICH IS NINETY-ONE AND SIXTY-SIX HUNDREDTHS (91.66) FEET
NORTH OF THE SOUTH LINE OF SAID LOT; RUNNING THENCE NORTH
ALONG THE WEST LINE OF THE EAST ONE HUNDRED FORTY (140)
FEET OF SAID LOT A DISTANCE OF SIXTY (60) FEET TO A POINT
WHICH IS ONE HUNDRED EIGHTY (180) FEET SOUTH OF THE NORTH
LINE OF SAID LOT; RUNNING THENCE WEST TO THE POINT OF
BEGINNING.
WHEREAS, it is the sense of the Council of the City of Waterloo, Iowa, that said request
should be granted.
NOW, THEREFORE, BE IT FURTHER RESOLVED that permission is hereby granted
to Roger Wooden, to construct a concrete driveway, with the elimination of the sidewalk section
due to the inability to meet grade requirements, located at 1421 Denver Street, subject to the
following conditions:
1. Work is to be performed by an approved and bonded contractor.
2. A permit is to be obtained from the office of the City Engineer prior to
construction.
3. All work shall be under the supervision of the City Engineer and at no cost
to the City of Waterloo.
BE IT FURTHER RESOLVED, that the City Clerk is authorized and directed to forward
a certified copy of this resolution to the Black Hawk County Recorder for recording and the
Resolution 2023-229

Black Hawk County Auditor for filing in order that this said action may become a matter of
official County Record.
PASSED AND ADOPTED this 17th day of April 2023.
