RESOLUTION NO. 2023-267 RESOLUTION APPROVING THE REQUEST OF TYLER MCCORMACK FOR A WAIVER FOR A CONCRETE DRIVEWAY, LOCATED AT 307 W. ORANGE ROAD, WITH THE ELIMINATION OF THE SIDEWALK SECTION DUE TO INABILITY TO MEET GRADE REQUIREMENTS. WHEREAS, the City Engineer has made written application to the City Council asking that Tyler McCormack, be authorized and permitted to construct a concrete driveway, with the elimination of the sidewalk section due to the inability to meet grade requirements, located at 307 W. Orange Road, and legally described as follows: THAT PART OF THE NORTHWEST QUARTER OF THE NORTHEAST QUARTER (NW'/a NE'/a) OF SECTION TWENTY-ONE (21), TOWNSHIP EIGHTY-EIGHT (88) NORTH, RANGE THIRTEEN (13) WEST OF THE 5TH P.M., BLACK HAWK COUNTY, IOWA, LYING WITHIN THE FOLLOWING BOUNDARIES: COMMENCING AT A POINT ON THE NORTH LINE OF SAID SECTION THAT IS 1620 FEET WEST OF A POINT THAT IS 29 17 /27 RODS WEST OF THE NORTHEAST CORNER OF SAID SECTION; RUNNING THENCE WEST ALONG THE NORTH LINE OF SAID SECTION A DISTANCE OF 133 FEET; THENCE SOUTH AT RIGHT ANGLES A DISTANCE OF 167 FEET; THENCE EAST ALONG A LINE THAT IS PARALLEL WITH THE NORTH LINE OF SAID SECTION A DISTANCE OF 133 FEET; THENCE NORTH A DISTANCE OF 167 FEET TO THE PLACE OF BEGINNING, EXCEPTING THAT PART THEREOF CONVEYED TO BLACK HAWK COUNTY, IOWA FOR ROAD PURPOSES BY WARRANTY DEED RECORDED IN BOOK 112 OF LAND DEEDS AT PAGE 31 OF THE RECORDS OF SAID COUNTY. WHEREAS, it is the sense of the Council of the City of Waterloo, Iowa, that said request should be granted. NOW, THEREFORE, BE IT FURTHER RESOLVED that permission is hereby granted to Tyler McCormack, to construct a concrete driveway, with the elimination of the sidewalk section due to the inability to meet grade requirements, located at 307 W. Orange Road, subject to the following conditions: 1. Work is to be performed by an approved and bonded contractor. 2. A permit is to be obtained from the office of the City Engineer prior to construction. 3. All work shall be under the supervision of the City Engineer and at no cost to the City of Waterloo. BE IT FURTHER RESOLVED, that the City Clerk is authorized and directed to forward a certified copy of this resolution to the Black Hawk County Recorder for recording and the Black Hawk County Auditor for filing in order that this said action may become a matter of official County Record.
