RESOLUTION NO. 2023-268 RESOLUTION APPROVING THE REQUEST OF REILLY BENEDICT FOR A WAIVER FOR A CONCRETE DRIVEWAY, LOCATED AT 225 LICHTY BLVD., WITH THE ELIMINATION OF THE SIDEWALK SECTION DUE TO INABILITY TO MEET GRADE REQUIREMENTS. WHEREAS, the City Engineer has made written application to the City Council asking that Reilly Benedict, be authorized and permitted to construct a concrete driveway, with the elimination of the sidewalk section due to the inability to meet grade requirements, located at 225 Lichty Blvd., and legally described as follows: LOT 27 IN LICHTY ORANGE ADDITION IN BLACK HAWK COUNTY, IOWA; AND UNIT 4115, 4115-4117 HARBIN DRIVE CONDOMINIUMS AND THE UNDIVIDED INTEREST IN THE COMMON ELEMENTS APPURTENANT TO SAID UNIT RECORDED IN DOC. NO. 20 1 1-06077 ON SEPTEMBER 27, 2010 AS LAID OUT ON LOT 21 IN AUDUBON PARK SIXTH ADDITION, WATERLOO, BLACK HAWK COUNTY, IOWA. THIS DEED IS EXEMPT ACCORDING TO IOWA CODE 428A.2(15). WHEREAS, it is the sense of the Council of the City of Waterloo, Iowa, that said request should be granted. NOW, THEREFORE, BE IT FURTHER RESOLVED that permission is hereby granted to Reilly Benedict, to construct a concrete driveway, with the elimination of the sidewalk section due to the inability to meet grade requirements, located at 225 Lichty Blvd., subject to the following conditions: 1. Work is to be performed by an approved and bonded contractor. 2. A permit is to be obtained from the office of the City Engineer prior to construction. 3. All work shall be under the supervision of the City Engineer and at no cost to the City of Waterloo. BE IT FURTHER RESOLVED, that the City Clerk is authorized and directed to forward a certified copy of this resolution to the Black Hawk County Recorder for recording and the Black Hawk County Auditor for filing in order that this said action may become a matter of official County Record.
