RESOLUTION APPROVING A DEVELOPMENT
AGREEMENT WITH JOHN & DAN PROPERTIES, LLC, FOR
THE OVERALL DEVELOPMENT OF INFRASTRUCTURE OF
THE SAN MARNAN BUSINESS PARK FIRST ADDITION, A
FOURTEEN LOT BUSINESS PARK SUBDIVISION,
INCLUDING TAX REBATES OF A MINIMUM OF $40,000.00
PER YEAR UP TO A MAXIMUM GRANT OF $2,020,040.00,
AND AUTHORIZING THE MAYOR AND CITY CLERK TO
EXECUTE SAID DOCUMENTS.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WATERLOO, IOWA,
that the Development Agreement dated May 15, 2023, between John & Dan Properties, LLC and
the City of Waterloo for the overall development of infrastructure of the San Marnan Business
Park First Addition, a fourteen lot business park subdivision, including tax rebates of a minimum
of$40,000.00 per year up to a maximum grant of$2,020,040.00, and legally described as
follows:
THAT PART OF THE EAST ONE-HALF OF THE NORTHWEST QUARTER
OF SECTION 9, TOWNSHIP 88 NORTH, RANGE 13 WEST OF THE 5TH
P.M., BLACK HAWK COUNTY, IOWA, LYING SOUTHERLY OF THE
SOUTHERLY RIGHT-OF-WAY LINE OF SAN MAMAN DRIVE AND LYING
NORTHERLY OF THE NORTHERLY RIGHT-OF-WAY LINE OF U.S.
HIGHWAY #20, EXCEPT THAT DEEDED IN DOC. #2006-04226 AND
EXCEPT THAT PART OF THE NORTHEAST QUARTER OF SAID
NORTHWEST QUARTER CONDEMNED IN DOC. #2006-18278
is hereby approved, and the Mayor and City Clerk are authorized and directed to execute said
document on behalf of the City of Waterloo, Iowa.
