Local Option Sales and Services Tax (Imposition).
• Resolution Regarding a Special Election on the Imposition of a Local Option Sales and
Services Tax within the City of Waterloo, Iowa.
NOTICE MUST BE GIVEN PURSUANT TO IOWA CODE
CHAPTER 21 AND THE LOCAL RULES OF THE CITY.
August 7, 2023
The City Council of the City of Waterloo, State of Iowa, met in regular session, in the
Council Chambers, City Hall, 715 Mulberry Street, Waterloo, Iowa, at 5:30 P.M., on the above
date. There were present Mayor Quentin Hart, in the chair, and the following named Council
Members:
Boesen, Nichols, Creighton -Smith, Chiles, Grieder and Wilder
Absent: Feuss
Vacant: None

Council Member Grieder introduced the following Resolution entitled "RESOLUTION
REGARDING A SPECIAL ELECTION ON THE IMPOSITION OF A LOCAL OPTION
SALES AND SERVICES TAX WITHIN THE CITY OF WATERLOO, IOWA," and moved
that the same be adopted. Council Member Chiles seconded the motion to adopt. The roll was
called and the vote was:
AYES: Boesen, Nichols, Creighton -Smith, Chiles Grieder and
Wilder

Whereupon, the Mayor declared the following Resolution duly adopted:
RESOLUTION NO. 2023-479
RESOLUTION REGARDING A SPECIAL ELECTION ON THE
IMPOSITION OF A LOCAL OPTION SALES AND SERVICES
TAX WITHIN THE CITY OF WATERLOO, IOWA
WHEREAS, Chapter 423B of the Iowa Code (the "Code") establishes the requirements
to request that the County Commissioner of Elections hold an election on the question of
imposing a local sales and services tax; and
WHEREAS, the Code provides that the question of the imposition of a local sales and
services tax shall be submitted to the registered voters of the incorporated and unincorporated
areas of the County upon receipt by the County Commissioner of Elections of the motion or
motions, requesting such submission, adopted by the governing body or bodies of the city or
cities located within the county or of the county, for the unincorporated area of the county,
representing at least one half of the population of the county; and
WHEREAS, the City Council of the City of Waterloo, Iowa is the governing body of a
city whose population constitutes in excess of one-half of the population of Black Hawk County;
and
WHEREAS, the local sales and services tax currently imposed in Waterloo, Iowa will
expire on December 31, 2025; and
WHEREAS, the City Council of Waterloo, Iowa, to avoid a lapse in the collection of
local sales and services tax revenues, desires that an election on the imposition of a new local
sales and services tax, effective January 1, 2026, be placed on the ballot for the November 7,
2023 election pursuant to Iowa Administration Code Section 701-270.2(2).
IOWA:
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF WATERLOO,

Section 1. That there is hereby called a special election on Tuesday the 7th of November,
2023, at which election there shall be submitted to the registered voters of the City of Waterloo,
Iowa the follow question, to wit:
SHALL THE FOLLOWING PUBLIC MEASURE BE ADOPTED? YES

Summary: To authorize imposition of a new local sales and services tax in the City of
Waterloo, that will continue without repeal of the existing local sales and services tax at the rate
of one percent (1%) to be effective on January 1, 2026, until repealed.
A new local sales and services tax shall be imposed in the City of Waterloo that will
continue without repeal of the existing local sales and services tax at the rate of one percent (1%)
to be effective on January 1, 2026.
Revenues from the sales and services tax are to be allocated as follows:
20% for property tax relief.
The specific purpose for which the revenues shall otherwise be expended is:
80% for construction, reconstruction, replacement, maintenance, and
improvement of city streets, curbs, storm sewers and related infrastructure.
Section 2. That the City Clerk is hereby authorized and directed to file a certified copy of
this Resolution in the office of the County Commissioner of Elections of Black Hawk County,
which filing shall also constitute the "written notice" to the County Commissioner of Elections
of the election date, and to notify the Black Hawk County Board of Supervisors of the adoption
of this Resolution.

proceedings of the Council, and the same is a true and complete copy of the action taken by the
Council with respect to the matter at the meeting held on the date indicated in the attachment,
which proceedings remain in full force and effect, and have not been amended or rescinded in
any way; that meeting and all action thereat was duly and publicly held in accordance with a
notice of meeting and tentative agenda, a copy of which was timely served on each member of
the Council and posted on a bulletin board or other prominent place easily accessible to the
public and clearly designated for that purpose at the principal office of the Council pursuant to
the local rules of the Council and the provisions of Chapter 21, Code of Iowa, upon reasonable
advance notice to the public and media at least twenty-four hours prior to the commencement of
the meeting as required by law and with members of the public present in attendance; I further
certify that the individuals named therein were on the date thereof duly and lawfully possessed of
their respective City offices as indicated therein, that no Council vacancy existed except as may
be stated in the proceedings, and that no controversy or litigation is pending, prayed or
threatened involving the incorporation, organization, existence or boundaries of the City or the
right of the individuals named therein as officers to their respective positions.
