HomeMy WebLinkAbout26149-01.15.1979 RESOLUTION NO. 2 6 1 4 9 RESOLUTION FIXING THE TIME AND PLACE OF HEARING AND RECEIVING OF BIDS AND DEVELOPMENT PROPOSALS AS FEBRUARY 5, 1979 AT 7:00 P.M. IN COUNCIL CHAMBERS OF CITY HALL ON THE PROPOSAL TO SELL AND CONVEY A PART OF SECTION 4-89N- 13W WITH CITY RETENTION OF EASEMENT AND SUBJECT TO CERT- AIN STIPULATIONS, TO A DEVELOPER SELECTED BY THE WATERLOO CITY COUNCIL. BE IT RESOLVED BY THE CITY OF WATERLOO, IOWA as follows: 1. That public hearing and receiving of bids will be held by the Council of the City of Waterloo, Iowa, in the Council Chambers of the City Hall of Water- loo, Iowa, at 7:00 o ' clock P.M. on the 5th day of February, 1979 on the proposal to sell and convey with certain stipulations certain real property in part of Section 4-89N-13W, South of Illinois Central Gulf Railroad and North of West Air- line Highway owned by the City of Waterloo, Iowa to a developer selected by the Waterloo City Council, plus costs, and legally described as follows: The West 875 feet of that part of the Southeast Quarter of the Southwest Quarter of Section 4, Township 89 North, Range 13 West of the 5th P.M. lying South of the Illinois Central Gulf Railroad in the City of Waterloo, Black Hawk County, Iowa except the South 60 feet subject to the following : 1. A utility easement over and across the North 40 feet of said parcel. 2. The City of Waterloo, Iowa reserves for itself, its Airport Commission, and for the use and benefit of the public, the right of flight for passage of aircraft in the airspace over- lying the premises above described, together with the right to cause in said airport such noise as may be inherent in the operation of aircraft using such airspace for landing at , or taking off from, or operating on the Waterloo Municipal Air- port. 3. Transferee will not erect any structure or object or permit any growth on said premises which would constitute an obstr- uction to flight in violation of the criteria set forth in Federal Aviation Agency Technical Standard Order No. N 18. 4. Transferee will not make use of the premises hereby conveyed in such a manner as to create electrical interference with radio communications between aircraft and ground stations, make it difficult for operators of aircraft to distinguish between lights on the Airport intended for aid in landing or taking off thereat , or in aerial navigation, and other lights, result in glare to the eyes of the operators of aircraft using the airport , impair visibility or otherwise make hazardous the landing or takeoff of aircraft at the Airport , or the maneuvering of aircraft in connection with such landing or takeoffs. 2. That the City Council is hereby authorized and directed to publish notice of the time and place of said heraring in the Waterloo Daily Courier by publication once not less than 4 days nor more than 20 days before the meeting of the Council at which said proposal is to be acted on.
