RESOLUTION AUTHORIZING THE SALE AND CONVEYANCE OF THE
8' ALLEY LYING NORTH OF AND ADJACENT TO LOT 1 FOR
$51 , 20 TO LARRY L . AND ILA J OWENS , THE 8 ' ALLEY
LYING NORTH OF AND ADJACENT TO LOT 2 AND TO LOT 5
FOR $80 . 72 TO WAYNE R. AND DOROTHY B ILLMAN , THE 8 '
ALLEY LYING NORTH OF ADJACENT TO LOT 3 FOR $40. 00
TO GEORGE V. EIGHMEY, AND THE 8 ' ALLEY LYING NORTH
OF AND ADJACENT TO LOT 4 FOR $40. 00 TO JOHN D, AND
MAXINE J , SCHARFENBERG, ALL IN WEISHAAR' S ADDITION
AND PLUS COSTS , WITH CITY' S RETENTION OF EASEMENT,
AND DIRECTING AND AUTHORIZING THE MAYOR AND CITY
CLERK TO EXECUTE AND DELIVER DEEDS FOR SAID PRO-
PERTY,
WHEREAS , the City of Waterloo , Iowa, is the owner of real property, in
the City of Waterloo , Iowa, as described below, and
WHEREAS , offers to purchase said certain parcel of real property in the
sums of $51 , 20, $80 . 72 , $40. 00 and $40. 00 plus costs , have been made by
Larry L , and Ila J . Owens , Wayne R. and Dorothy M, Billman, George V. Eighmey,
and John D . and Maxine J . Scharfenberg, and
WHEREAS , a public hearing was held on February 5 , 1979 at 7 : 00 P .M, in
the Council Chambers in City Hall , Waterloo, Iowa, as provided by law, by
the Council of the City of Waterloo, Iowa, on the proposal to sell and convey
premises owned by the City of Waterloo , Iowa to Larry L. and Ila J . Owens ,
Wayne R. and Dorothy M. Billman, George V. Eighmey, and John D , and Maxine J .
Scharfenberg, and
WHEREAS, it is the opinion of this Council that sale and conveyance
should be made as proposed.
NOW, THEREFORE, IT IS HEREBY RESOLVED BY THE COUNCIL OF THE CITY OF
WATERLOO, IOWA, AS FOLLOWS :
1 . The following described real property, as fully described in the published.
notice in the Waterloo Courier, on January 12, 1979 , is not presently needed
and will not be needed in the foreseeable future for municipal purposes and
its ownership is serving no municipal purposes :
To : Larry L. and Ila J. Owens for $51 , 20 the following legally described
parcel , with City retention of a utility easement over, under and upon:
The eight (8) foot alley lying North of and adjacent to Lot 1 ,
Weishaar ' s Addition, City of Waterloo, Black Hawk County, Iowa .
To : Wayne R. and Dorothy M. Billman for $80. 72 the following legally described
parcel with City retention of a utility easement over, under and upon:
The eight (8) foot alley lying North of and adjacent to Lot 2 and.
the eight (8) foot alley lying North of and adjacent to Lot 5 ,
Weishaar ' s Addition, City of Waterloo , Black Hawk County, Iowa.
To : George V, Eighmey for $40. 00 the following legally described parcel with
City retention of a utility easement over, under and upon:
The eight (8) foot alley lying North of and adjacent to Lot 3,
Weishaar ' s Addition, City of Waterloo , Black Hawk County, Iowa
To : John D. and Maxine J . Scharfenberg, for $40. 00 the following legally de-
scribed parcel with City retention of a utility easement over, under and upon:
The eight (8) foot alley lying North of and adjacent to Lot 4,
Weishaar ' s Addition, City of Waterloo, Black Hawk County, Iowa.
2 . That the offers of Larry L. and Ila J , Owens , Wayne R. and Dorothy M. Bill-
man, George V. Eighmey and John D . and Maxine J . Scharfenberg, to purchase
said real property for the sums of Fifty-one and 20/100, ($51 . 20) , Eighty and
72/100 ($80. 72) , Forty and no/100 ($40. 00) , and Forty and no/100 ($40, 00)
Dollars and costs respectively be , and are hereby accepted with the City of
Waterloo, Iowa, to retain a utility easement over, under and upon the parcels
as above mentioned.
3. That the City of Waterloo, Iowa, convey said parcel of real property to
Larry L. and Ila J . Owens , Wayne R. and Dorothy M. Billman, George V. Eighmey
and John D . and Maxine J. Scharfenberg by Quit Claim Deeds , the forms of
which are hereto attached and approved .
4. That the Mayor and City Clerk are hereby authorized to execute and deliver
said deeds to Larry L . and Ila J . Owens , Wayne R. and Dorothy M , Billman,
George V. Eighmey and John D. and Maxine J . Scharfenberg,
5. That the originals of said deeds fully executed and acknowledged having
been submitted with this Resolution, the same are hereby approved and con-
firmed by the Council .
6.. That the City Clerk is authorized and directed to deliver said deeds of
conveyance to Larry L. and Ila J . Owens , Wayne R, and Dorothy M , Billman,
George V. Eighmey and John D and Maxine J . Scharfenberg, Waterloo, Iowa,
upon receipts of the sums of Fifty-one and 20/100 ($51 . 20) , Eighty and 72/100
($80. 72) , Forty and no/100 ($40. 00) , and Forty and no/100 ($40. 00) Dollars
and costs respectively.
Passed and adopted this 12th day of February, 1979 .
