HomeMy WebLinkAbout26189-02.19.1979 RESOLUTION NO. / g A RESOLUTION AUTHORIZING THE SALE OF DISPOSAL PARCEL NO. VC-6(P) LOCATED ALONG THE EAST BANK OF THE CEDAR RIVER IN THE WATERLOO FLOOD PROTECTION PROJECT AREA WHEREAS, in order to construct and maintain a flood protection system to protect the land within the City it will be necessary to relocate and construct a new discharge structure along the Cedar River; and WHEREAS, it will be the obligation of the Iowa Public Service Company to operate, maintain and protect the new outlet structure; and WHEREAS, Iowa Public Service Company desires to acquire the parcel of land upon which the new outlet structure will be built for the sum of $1.00 and other valuable consideration; and WHEREAS, the sale of said land under the conditions described herein has been approved by the Community Development Board. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WATERLOO, IOWA: 1. That the terms and conditions of the proposed agreement for the sale of parcel VC-6(P) in the Flood Protection Project area more particularly described as: (See attached plat and legal description) as set forth in the Proposal to Purchase property for private redevelopment executed by the Iowa Public Service Company is satisfactory and hereby approved. 2. That the prospective purchaser possesses the qualifications and financial resources necessary to acquire and develop said land. 3. That the Community Development Staff be and it is hereby authorized to prepare a deed for the conveyance of said property and to submit the same to this Council for final approval and execution in the event said offer is accepted. 4. That this action of the Council be considered to be and in fact does constitute a notice to all concerned of the intention of the Council to accept the offer of the Iowa Public Service Company to purchase said parcel and to give a deed to the same after hearing and notice. 5. That the City Clerk be and is authorized and directed to publish a Thirty (30) Day Notice of Hearing in conformance with Section 403.8(2) of the 1958 Code of Iowa.
