A RESOLUTION OVERRULING THE OBJECTIONS,
TO F.Y. 1979 PAVING PROGRAM NO. 1 , CON-
TRACT NO. 166.
WHEREAS, a resolution of necessity proposing the construction of
paving of certain streets and parts of streets in the City of Waterloo,
Iowa, known as F .Y. 1979 Paving Program No. 1 , Contract No. 166, as set
out in Resolution No. 26231 , was proposed to this Council, approved by
it and notice of pendency thereof ordered given on March 19, 1979, and
WHEREAS, at the time fixed for the consideration of said resolut-
ion, objections were made by:
1 . Merrild T. Fortune and .Alentha M. Fortune, 3541 Hammond Avenue, to
method of payment for extension of Flammang Drive to Hammond Avenue;
2. M.L . Davenport , 3349 Hammond Avenue, et al , to proposed assessment
for Flammang Drive;
3. Frank H. and Jo Ann Collings, to Flammang Drive;
4. Mr. and Mrs. Carroll Trout , 3638 E. Shaulis Road , to Cedar Terrace
Drive;
5. Mrs. Bessie Turner, 5640 Foulk Road to Foulk Road;
6. James E . Walsh, Jr. Atty. for Robert B. and Shirley Wilson, 3561
Hammond Avenue, presented an objection to assessments to Flammang
Drive;
7 . Mike Diers, 3726 East Shaulis Street , stated an open ditch would be
left and asked that more length be added to culvert going under drive-
way;
8. Jeryl Stewart , 5073 Foulk Road , objected to cost of concrete;
9. John Bessor, 5037 Foulk Road, objected to storm sewer plan, his corner
10 ' deep and needed modification;
10.Eugene Geary, 5050 Foulk Road , supported Bessie Turner for seven bal-
lots and Silver Lake Estates right to vote;
11 .Ed Pauley, 5471 Foulk Road , objected to concrete, curb and gutter and
storm sewer;
12.Gary Foulk objected to storm sewer and curb and gutter as have good
drainage ditch;
13 .Don Bauler, 5461 Foulk Road , protested raise in assessment , over first
program;
14.Judith Fraser, 5137 Foulk Road , objected to concrete, curb and gutter
and storm sewer as lead-in street Shaulis Road was asphalt and satis-
factory;
15.David Heminover, 5377 Tucson Drive, stated the vote was for asphalt
with storm sewer and curb and gutter and proposed plans are open ditch
and 4" slab;
and others, and
WHEREAS, this Council has fully considered all said objections and
finds that the objections, described as above, filed to the passage of
resolution of necessity and to making of the improvement therein describ-
ed , are without merit and should be overruled , now, therefore,
BE IT RESOLVED RY THE COUNCIL OF THE CITY OF WATERLOO, IOWA, that
the said objections , and all other objections, be and the same are
hereby overruled.
