RESOLUTION AUTHORIZING THE SALE AND CONVEYANCE OF 20 ' WIDE
ALLEY WITHIN BLOCK 6, HAYE'S ADDITION, WITH CITY'S RETENT-
ION OF UTILITY EASEMENT, FOR $0. 10 PER SQ. FOOT PLUS COSTS;
TO HARRY OTTO ASCHBRENNER THE NE 1/2 OF ALLEY ADJACENT TO
LOT 1, FOR $60.00 PLUS COSTS; TO RODNEY J. AND BARBARA L .
HENRY NE 1/2 OF ALLEY ADJACENT TO LOTS 2 AND 3 FOR $120 PLUS
COSTS; MAX D. EATON INSULATION, INC. , THE NE 1/2 OF ALLEY
ADJACENT TO LOTS 4 AND 5, FOR $120 PLUS COSTS ; FLOYD J. OLTRO-
GGE THE SW 1/2 OF ALLEY ADJACENT TO LOT 6 FOR $60.03 PLUS COSTS;
LULU I. BRANDES THE SW 1/2 OF ALLEY ADJACENT TO LOT 7 FOR $60.00
PLUS COSTS; TO LEO AND JEAN PLOTZ THE SW 1/2 OF ALLEY ADJACENT
TO LOTS 8 AND 9 FOR $120.00 PLUS COSTS, AND TO ADELINE M. CALIFF
THE SW 1/2 OF ALLEY ADJACENT TO LOT 10 FOR $60. 00 PLUS COSTS, ALL
IN BLOCK 6, HAYE'S ADDITION, AND DIRECTING .AND AUTHORIZING THE
MAYOR AND CITY CLERK TO EXECUTE AND DELIVER DEEDS FOR SAID PROPERTY.
WHEREAS, the City of Waterloo, Iowa, is the owner of real property
in the City of Waterloo, Iowa, as described below, and
WHEREAS, offers as shown below, to purchase said certain parcel of
real property have been made by Harry Otto Aschbrenner, Rodney J. and
Barbara L. Henry, Max D. Eaton Insulation, Inc. , Floyd J. Oltrogge, Lulu
I. Brander, Leo and Jean Plotz, and Adeline M. Califf, and
WHEREAS, a public hearing was held on June 25, 1979 at 7:00 P.M. in
the Council Chambers in City Hall, Waterloo, Iowa, as provided by law, by
the Council of the City of Waterloo, Iowa, on the proposal to Sell and con-
vey premises owned by the City of Waterloo, Iowa, to Harry Otto Aschbrenner,
Rodney J and Barbara L. Henry, Max D. Eaton Insulation, Inc. , Floyd J. Olt-
rogge, Lulu I . Brander, Leo and Jean Plotz, and Adeline M. Califf, and
WHEREAS, it is the opinion of this Council that sale and conveyance
Should be made as proposed, with City ' s retention of utility easement,
NOW, THEREFORE, IT IS HEREBY RESOLVED BY THE COUNCIL OF THE CITY OF
WATERLOO, IOWA, AS FOLLOWS :
1. The following described real property, as fully described in the
published notice in the Waterloo Courier on June 8, 1979, is not presently
needed and will not be needed in the foreseeable future for municipal pur-
poses and its ownership is serving no municipal purpose:

To: Harry Otto Aschbrenner for $60. 00 plus costs the following legally des-
cribed parcel, with City retention of a utility easement over, under and upon:
The northeast one-half of the alley lying adjacent to Lot 1, Block
6, Haye ' s Addition, City of Waterloo, Black Hawk County, Iowa .
To: Rodney J. and Barbara L. Henry for $120.00 plus costs the following legally
described parcel with City retention of a utility easement over, under and upon
The northeast one-half of the alley lying adjacent to Lots 2 and 3, Block
6, Haye ' s Addition, City of Waterloo, Black Hawk County, Iowa .
To: Max D. Eaton Insulation, Inc. , for $120.00 plus costs the following legally
described parcel with City retention of a utility easement over, under and upon
The northeast one-half of the alley lying adjacent to Lots 4 and 5, Block
6, Haye ' s Addition, City of Waterloo, Black Hawk County, Iowa .
To: Floyd J. Oltrogge for $60.00 plus costs the following legally described
parcel with City retention of a utility easement over, under and upon:
The southwest one-half of the alley lying adjacent to Lot 6, Block
6, Haye ' s Addition, City of Waterloo, Black Hawk County, Iowa.
To: Lulu I. Brander for $60.00 plus costs the following legally described
parcel with City retention of a utility easement over, under and upon:
The southwest one-half of the alley lying adjacent to Lot 7, Block
6, Haye ' s Addition, City of Waterloo, Black Hawk County, Iowa .

To: Leo and Jean Plotz for $120.00 plus costs the following legally describ-
ed parcel with City retention of a utility easement over, under and upon:
The southwest one-half of the alley lying adjacent to Lots 8 and 9
Block 6, Haye ' s Addition, City of Waterloo, Black Hawk County, Iowa.
To: Adeline M. Califf for $60.00 plus costs the following legally described
parcel with City retention of a utility easement over, under and upon:
The southwest one-half of the alley lying adjacent to Lot 10, Block
6, Haye ' s Addition, City of Waterloo, Black Hawk County, Iowa .
2. That the offers of Harry Otto Aschbrenner, Rodney J. and Barbara
L. Henry, Max D. Eaton Insulation, Inc. , Floyd J. Oltrogge, Lulu I . Brander,
Leo and Jean Plotz, and Adeline M. Califf, to purchase said real property
for the above sums and costs be, and they are hereby accepted for the above
described real property.
3 . That the City of Waterloo, Iowa, convey said parcel of real property
to Harry Otto Aschbrenner, Rodney J. and Barbara L. Henry, Max D. Eaton In-
sulation, Inc. , Floyd J. Oltrogge, Lulu I. Brander, Leo and Jean Plotz, and
Adeline M. Califf, by Quit Claim Deeds, the forms of which are hereto attach-
ed and approved , with the City of Waterloo, Iowa, to retain a utility easement
4. That the Mayor and City Clerk are hereby authorized to execute and
deliver said deeds to Harry Otto Aschbrenner, Rodney J. and Barbara L. Henry,
Max D. Eaton Insulation, Inc. , Floyd J. Oltrogge, Lulu I. Brandes, Leo and
Jean Plotz, and Adeline M. Califf,
5 . That the original of said deeds fully executed and acknowledged hav-
ing been submitted with this Resolution, the same are hereby approved and
confirmed by the Council.
6. That the City Clerk is authorized and directed to deliver said deeds
of conveyance to Harry Otto Aschbrenner, Rodney J. and Barbara L . Henry, Max
D. Eaton Insulation, Inc. , Floyd J. Oltrogge, Lulu I. Brander, Leo and Jean
Plotz, and Adeline M. Califf, upon receipt of the above sums and costs.
Passed and adopted this 25th day of June, 1979.
