RESOLUTION NO. 2023-512 RESOLUTION APPROVING THE SALE AND CONVEYANCE OF CITY-OWNED PROPERTY LOCATED NEAR 1714 RIVER STREET IN THE AMOUNT OF $1.00, TO C&C WELDING, INC., AND AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE SAID DOCUMENTS. WHEREAS, the City of Waterloo, Iowa is the owner of property located near 1714 River Street, in the City of Waterloo, Iowa, and legally described as follows: THAT PART OF PLATTED WEST 16TH STREET, LYING NORTHEASTERLY OF A LINE DRAWN BETWEEN THE SOUTHEASTERLY CORNER OF LOT 1, BLOCK 17, HAYES ADDITION AND THE SOUTHWESTERLY CORNER OF LOT 5, BLOCK 16, HAYES ADDITION, AND LYING SOUTHWESTERLY OF A LINE DRAWN BETWEEN THE NORTHEASTERLY CORNER OF LOT 1, BLOCK 16, HAYES ADDITION, AND THE NORTHWESTERLY CORNER OF LOT 5, BLOCK 16, HAYES ADDITION SUBJECT TO THE RETENTION OF AN ACCESS EASEMENT AND A PUBLIC UTILITY EASEMENT FOR THE BENEFIT OF LOTS 4 AND 5, BLOCK 16, HAYES ADDITION, OVER, UNDER, UPON, AND ACROSS THE SOUTHEASTERLY 50 FEET OF THE DESCRIBED PARCEL, AND ALSO SUBJECT TO THE RETENTION OF AN EASEMENT FOR PUBLIC WATER UTILITIES OVER, UNDER, UPON, AND ACROSS THE SOUTHEASTERLY 30 FEET OF THE NORTHWESTERLY 45 FEET OF THE SOUTHWESTERLY 25 FEET OF SAID PARCEL WHEREAS, an offer to purchase said city-owned property, in the amount of$1.00, has been made by C&C Welding, Inc., and WHEREAS, a public hearing was held on August 21, 2023, at 5:30 p.m. in the Harold E. Getty Council Chambers, City Hall, Waterloo, Iowa, as provided by law, by the Council of the City of Waterloo, Iowa, on the proposal to sell and convey premises owned by the City of Waterloo, Iowa, to C&C Welding, Inc., for the construction of a 10,000 square foot industrial building, with a minimum assessed value of$550,000.00, and WHEREAS, it is the opinion of this Council that the sale and conveyance should be made as proposed. NOW, THEREFORE, IT IS HEREBY RESOLVED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA, AS FOLLOWS: 1. The city-owned property located near 1714 River Street, in the City of Waterloo, Iowa, as fully described in the published notice in the Waterloo Courier on August 12, 2023, is not presently needed, and will not be needed in the foreseeable future for municipal purposes, and its ownership is serving no municipal purpose. 2. That the offer of C&C Welding, Inc., to purchase the city-owned property, located near 1714 River Street, in the City of Waterloo, Iowa, in the amount of$1.00, is hereby accepted for said property. 3. That the City of Waterloo, Iowa conveys said parcel of real property to C&C Welding, Inc.,by quit claim deed. (� ) , Resolution 2023-512 Page 2 4. That the Mayor and City Clerk are authorized and directed to execute said deed. 5. That the original of said quit claim deed, fully executed and acknowledged, is hereby approved and confirmed by this Council. 6. That the Community Planning and Development Director is authorized and directed to deliver said deed of conveyance to C&C Welding, Inc., upon execution of said document and receipt of payment of$1.00.
