HomeMy WebLinkAbout2010-178-03/08/2010RESOLUTION NO. 2010-178 RESOLUTION APPROVING DEVELOPMENT AGREEMENT WITH IOWA HEARTLAND HABITAT FOR HUMANITY AND DIRECTING EXECUTION OF SAID AGREEMENT BY MAYOR. BE IT RESOLVED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA, that the Development Agreement dated March 8, 2010, for sale and conveyance of city -owned property generally located at 1333 Leavitt Street for $1.00, by and between Iowa Heartland Habitat for Humanity and the City of Waterloo, Iowa, be and the same is hereby approved, and the Mayor and City Clerk authorized to execute the same in behalf of the City of Waterloo, Iowa. Clark, Mayor ATTEST: Suzy Sc a s, CMC City Clerk, RESOLUTION NO. 2010-177 RESOLUTION AUTHORIZING THE SALE AND CONVEYANCE OF PROPERTY GENERALLY LOCATED AT 1333 LEAVITT STREET, FOR $1.00, PLUS COSTS, AND AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE AND DELIVER DEED FOR SAME. WHEREAS, the City of Waterloo, Iowa, is the owner of real property in the City of Waterloo, Iowa, as described below, and WHEREAS, an offer to purchase said certain parcel of real property in the sum of $1.00, plus casts, has been made by Iowa Heartland Habitat for Humanity, and WHEREAS, a public hearing was held on March 8, 2010, at 5:30 p.m. in the Council Chambers in City Hall, Waterloo, Iowa, as provided by law, by the Council of the City of Waterloo, Iowa, on the proposal to sell and convey premises owned by the City of Waterloo, Iowa, to Iowa Heartland Habitat for Humanity, and WHEREAS, it is the opinion of this Council that sale and conveyance should be made as proposed. NOW, THEREFORE, IT IS HEREBY RESOLVED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA, AS FOLLOWS: 1. The following described real property, as fully described in the published notice in the Waterloo Courier on March 4, 2010, is not presently needed and will not be needed in the foreseeable future for municipal purposes and its ownership is serving no municipal purpose, and 2. That the offer of Iowa Heartland Habitat for Humanity to purchase real property for the sum of $1.00, and costs, be and it is hereby accepted for real property described below: Millers Fifth Addition Lot 7 Block 1, all in the City of Waterloo, Black Hawk County, Iowa. 3. That the City of Waterloo, Iowa convey said parcel of real property to Iowa Heartland Habitat for Humanity by deed. 4. That the Mayor and City Clerk are hereby authorized to execute and deliver deed to Iowa Heartland Habitat for Humanity. 5. That the original of said deed fully executed and acknowledged is hereby approved and confirmed by the Council. 6. That the City Clerk is authorized and directed to deliver said deed of conveyance to Iowa Heartland Habitat for Humanity upon receipt of the sum of $1.00, and costs. Clark, Mayor ATTEST: I ��7 Suzy S ares, CMC City Clerk RESOLUTION NO. 2010-176 RESOLUTION ORDERING THE CONSTRUCTION OF THE F.Y. 2010 CEDAR PRAIRIE TRAIL BRIDGE REPAIRS, CONTRACT NO. 764. WHEREAS, by Resolution No. 2010-175, plans, specifications, form of contract, etc., for the F.Y. 2010 Cedar Prairie Trail Bridge Repairs, Contract No. 764, in the City of Waterloo, Iowa, have been approved and adopted by this Council after the hearing prescribed by statute. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA, that it is deemed advisable and necessary and it is so ordered on motion by this Council that the said improvements be constructed in accordance with said plans and specifications. That the work herein ordered is to be paid in monthly estimates, in cash, on the basis of 90 percent of the work as the same is completed and materials delivered and the work approved, except that before the last month's payment is made the contractor may be required to furnish the City Council vouchers showing that all subcontractors and workmen and persons furnishing materials have been fully paid for such materials and labor, and that the City may retain the last month's payment for a period of 31 days following such completion and approval, unless satisfied that materials, men and laborers have been paid. That said work shall be done by contract and shall be commenced promptly after receipt of "Notice to Proceed". PASSED AND ADOPTED this 8th day of March, 2010. vLLZ Ernest G.
