RESOLUTION NO. 2023-589
RESOLUTION RESETTING DATE OF PUBLIC HEARING AS
OCTOBER 16, 2023, FOR THE SALE AND CONVEYANCE OF
CITY -OWNED PROPERTY TO A&K VENTURES, LLC, IN
THE AMOUNT OF $1.00, WITH A PHASED DEVELOPMENT
AND MINIMUM ASSESSMENT AGREEMENT IN THE
AMOUNT OF $624,125.00, FOR THE CONSTRUCTION OF A
6,500 SQUARE FOOT BUILDING AND A 6,000 SQUARE
FOOT ADDITION, LOCATED NORTHEAST OF 3151 TITAN
TRAIL, AND INSTRUCT THE CITY CLERK TO PUBLISH
NOTICE.
WHEREAS, a public hearing was held on August 7, 2023, in conjunction with the sale
and conveyance of city -owned property to A&K Ventures, LLC, in the amount of $1.00, with a
phased Development and Minimum Assessment Agreement in the amount of $624,125.00, for
the construction of a 6,500 square foot building and a 6,000 square foot addition, located
northeast of 3151 Titan Trail.
WHEREAS, notice of publication of said hearing per Iowa Code Section 362.3 was not
published timely by the Waterloo Courier.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
WATERLOO, IOWA, that the Council of the City of Waterloo, Iowa, meet in the Harold E.
Getty Council Chambers at City Hall, Waterloo, Iowa, at 5:30 p.m. on the 16th day of October
2023, to re -open the public hearing, in conjunction with the sale and conveyance of city -owned
property to A&K Ventures, LLC, in the amount of $1.00, with a phased Development and
Minimum Assessment Agreement in the amount of $624,125.00, for the construction of a 6,500
square foot building and a 6,000 square foot addition, located northeast of 3151 Titan Trail.
BE IT FURTHER RESOLVED, that the City Clerk is now directed to publish notice of
the time and place of said hearing in the Waterloo Courier.
PASSED AND ADOPTED this 2'd day of October 2023.
