RESOLUTION APPROVING THE SALE AND CONVEYANCE
OF CITY-OWNED PROPERTY LOCATED AT 3921 MIDWAY
DRIVE, IN THE AMOUNT OF $15,000.00, TO DUSTIN
ARENDS D/B/A ARENDS INVESTMENTS, AND
AUTHORIZING THE MAYOR AND CITY CLERK TO
EXECUTE SAID DOCUMENTS.
WHEREAS, the City of Waterloo, Iowa is the owner of property located at 21 Midway
Drive, in the City of Waterloo, Iowa, and legally described as follows: ` //h/k,
LOT NO. W-SEVENTY-SIX (W-76) IN "CEDARLO/ I/iK", IN BLACK
HAWK COUNTY, IOWA
WHEREAS, an offer to purchase said city-owned property, in the amount of$15,000.00,
has been made by Dustin Arends, D/B/A Arends Investments, and
WHEREAS, a public hearing was held on September 18, 2023, at X30 p.m. in the Harold
E. Getty Council Chambers, City Hall, Waterloo, Iowa, as provided by law, by the Council of the
City of Waterloo, Iowa, on the proposal to sell and convey prei ises owned by the City of
Waterloo, Iowa, to Dustin Arends, D/B/A Arends Investments, for the demolition of the existing
home and construction of a new duplex, and
WHEREAS, it is the opi n of this Council that the sale and conveyance should be made
as proposed.
NOW, THEREFORE, IT IS HEREB�RESOLVED BY THE COUNCIL OF THE CITY
OF WATERLOO, IOWA, AS FOLLO S.
1. The city-owned property located at 3921 Midway Drive, in the City of Waterloo,
Iowa, as fully described in the published notice in the Waterloo Courier on August 19, 2023, is
not presently needed, and will not be needed in the foreseeable future for municipal purposes, and
its ownership is serving no municipal purpose.
2. That the offer of Dustin Arends, D/B/A Arends Investments, to purchase the city-
owned property, located at 3921 Midway Drive, in the City of Waterloo, Iowa, in the amount of
$15,000.00, is hereby accepted for said property.
3. That the City of Waterloo, Iowa conveys said parcel of real property to Dustin Arends,
D/B/A Arends Investments, by quit claim deed.
4. That the Mayor and City Clerk are authorized and directed to execute said deed.
5. That the original of said quit claim deed, fully executed and acknowledged, is hereby
approved and confirmed by this Council.
6. That the Community Planning and Development Director is authorized and directed to
deliver said deed of conveyance to Dustin Arends, D/B/A Arends Investments, upon execution of
said document and receipt of payment of$15,000.00 with the sum of$1,000.00 earnest money to
be applied to the purchase price at closing.

WHEREAS, it is the opinion of this Council that the sale and conveyance should be made
as proposed.
NOW, THEREFORE, IT IS HEREBY RESOLVED BY THE COUNCIL OF THE CITY
OF WATERLOO, IOWA, AS FOLLOWS:
