RESOLUTION NO. 2023-632 RESOLUTION APPROVING THE REQUEST OF INONA FAIRCHILD FOR A WAIVER FOR A CONCRETE DRIVEWAY, LOCATED AT 2558 INDEPENDENCE AVENUE, WITH THE ELIMINATION OF THE SIDEWALK SECTION DUE TO INABILITY TO MEET GRADE REQUIREMENTS. WHEREAS, the City Engineer has made a written application to the City Council asking that Inona Fairchild, be authorized and permitted to construct a concrete driveway, with the elimination of the sidewalk section due to the inability to meet grade requirements, located at 2558 Independence Avenue and legally described as follows: A PART OF THE NORTHWEST QUARTER OF THE NORTHEAST QUARTER OF SECTION 29, TOWNSHIP 89 NORTH, RANGE 12 WEST OF THE 5TH P.M., IN THE CITY OF WATERLOO, IOWA DESCRIBED AS FOLLOWS: BEGINNING AT THE NORTHWEST CORNER OF THE SAID NORTHWEST QUARTER OF THE NORTHEAST QUARTER; THENCE EAST ALONG THE NORTH LINE OF SAID SECTION A DISTANCE OF 426.8 FEET; THENCE SOUTH 316 FEET; THENCE WEST ALONG A LINE THAT IS PARALLEL WITH THE NORTH LINE OF SAID SECTION TO THE WEST LINE OF SAID NORTHWEST QUARTER OF THE NORTHEAST QUARTER; THENCE NORTHERLY ALONG SAID WEST LINE TO THE POINT OF BEGINNING, EXCEPT THE WEST 212.77 FEET THEREOF SUBJECT TO EASEMENTS, RESTRICTIONS, COVENANTS, ORDINANCES, AND LIMITED ACCESS PROVISIONS OF RECORD. WHEREAS, it is the sense of the Council of the City of Waterloo, Iowa, that the request should be granted. NOW, THEREFORE, BE IT FURTHER RESOLVED that permission is hereby granted to Inona Fairchild, to construct a concrete driveway, with the elimination of the sidewalk section due to the inability to meet grade requirements, located at 2558 Independence Avenue, subject to the following conditions: 1. Work is to be performed by an approved and bonded contractor. 2. A permit is to be obtained from the office of the City Engineer prior to construction. 3. All work shall be under the supervision of the City Engineer and at no cost to the City of Waterloo. BE IT FURTHER RESOLVED, that the City Clerk is authorized and directed to forward a certified copy of this resolution to the Black Hawk County Recorder for recording and the Black Hawk County Auditor for filing in order that this said action shall become a matter of official County Record.
