RESOLUTION AUTHORIZING THE SALE AND
CONVEYANCE OF A 108' X 249' OR 26,495 SQUARE
FOOT PORTION OF CITY -OWNED PROPERTY GENERALLY
LOCATED AT 522 ALBANY STREET IN THE AMOUNT OF
$2,042.50, PLUS COSTS, AND AUTHORIZING THE
MAYOR AND CITY CLERK TO EXECUTE AND DELIVER
DEED FOR SAME.
WHEREAS, the City of Waterloo, Iowa, is the owner of real
property in the City of Waterloo, Iowa, as described below, and
WHEREAS, an offer to purchase said certain parcels of real
property in the sum of $2,042.50, plus costs, has been made by
Lola Burt, and
WHEREAS, a public hearing was held on April 5, 2010, at 5:30
p.m. in the Council Chambers in City Hall, Waterloo, Iowa, as
provided by law, by the Council of the City of Waterloo, Iowa, on
the proposal to sell and convey premises owned by the City of
Waterloo, Iowa, to Lola Burt, and
WHEREAS, it is the opinion of this Council that sale and
conveyance should be made as proposed.
NOW, THEREFORE, IT IS HEREBY RESOLVED BY THE COUNCIL OF THE
CITY OF WATERLOO, IOWA, AS FOLLOWS:
1. The following described real property, as fully
described in the published notice in the Waterloo Courier on
March 26, 2010, is not presently needed and will not be needed in
the foreseeable future for municipal purposes and its ownership
is serving no municipal purpose, and
2. That the offer of Lola Burt to purchase real property
for the sum of $2,042.50, and costs, be and it is hereby accepted
for real property described below:
That part of the Northwest Quarter of the Southwest
Quarter (NW 1/ SW 1/) of Section No. 19, Township No. 89
North, Range No. 12 West of the Fifth Principal
Meridian, City of Waterloo, Black Hawk County, Iowa,
described as follows:
Commencing at the Northwest corner of Lot No. 1,
Block No. 3 of "Shilliams Fourth Addition", point being
a found iron bar;
thence along the South right-of-way line of Albany
Street North 89040' West a distance of 18.15 feet to
the West line of the alley located West of said Block
No. 3, point being a found 7/8ffO iron pin, also being
the point of beginning;
thence along said West line South 00039' West a
distance of 249.4 feet to the Northerly line of
Acquisition Plat recorded in Misc. Book 568 Page 192 in
the Office of the Black Hawk County Recorder, point
being a set M" rebar with license #16264;
thence along said Northerly line North 89037' West
a distance of 108.05 feet to a set M" rebar with
license #16264
thence North 00039' East a distance of 244.9 feet
to the South right-of-way line of said Albany Street,
point being a set M" rebar with license #16264;
thence along said South right-of-way Due East a
distance of 108.0 feet to the point of beginning.

Containing 26,690 square feet.
Subject to restrictions, easements, covenants,
ordinances, and limited access provisions of record and
not of record.
Note: The South line of said Albany Street is assumed to
bear Due East for this description, all in the City of
Waterloo, Black Hawk County, Iowa.
3. That the City of Waterloo, Iowa, convey said parcels of
real property to Lola Burt by deed.
4. That the Mayor and City Clerk are hereby authorized to
execute and deliver deed to Lola Burt.
5. That the original of said deed fully executed and
acknowledged is hereby approved and confirmed by the Council.
6. That the City Clerk is authorized and directed to
deliver said deed of conveyance to Lola Burt upon receipt of the
sum of $2,042.50, and costs.

RESOLUTION NO. 2010-215
RESOLUTION APPROVING ACKNOWLEDGEMENT/
SETTLEMENT AGREEMENT WITH METRO MART 4, 2332
FALLS AVENUE, AND DIRECTING EXECUTION OF SAID
AGREEMENT BY MAYOR.
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA,
that the Acknowledgement/Settlement Agreement dated March 22,
2010, in the amount of $1,500.00, in conjunction with settlement
of violation of tobacco laws, by and between Metro Mart 4, 2332
Falls Avenue, Waterloo, Iowa and the City of Waterloo, Iowa, be
and the same is hereby approved, and the Mayor and City Clerk
authorized to execute the same in behalf of the City of Waterloo,
Iowa.
