AND DIRECTING EXECUTION OF SAID AGREEMENT BY MAYOR. BE IT RESOLVED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA, that the Right -of -Entry Agreement dated April 5, 2010, to construct a pump station on the National Cattle Congress grounds in conjunction with the Riverfront Renaissance Project, by and between The National Cattle Congress Inc. of Waterloo, Iowa and the City of Waterloo, Iowa, be and the same is hereby approved, and the Mayor authorized to execute the same in behalf of the City of Waterloo, Iowa. Clark, Mayor ATTEST: Suzy S es, CMC City Clerk RESOLUTION NO. 2010-229 RESOLUTION FIXING THE TIME AND PLACE OF HEARING AND NOTICE TO BE GIVEN ON THE SALE AND CONVEYANCE OF CITY -OWNED LAND ABUTTING 3900 ALEXANDRIA DRIVE TO D & J INVESTMENTS INC. AS APRIL 12, 2010, AT 5:30 P.M. IN CITY HALL COUNCIL CHAMBERS, WATERLOO, IOWA, AND INSTRUCTING THE CITY CLERK TO PUBLISH THE NOTICE OF HEARING. BE IT RESOLVED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA, AS FOLLOWS: Section 1. That the Council of the City of Waterloo, Iowa, shall meet at City Hall Council Chambers in the City of Waterloo, Iowa, at 5:30 p.m. on the 12th day of April, 2010, for the purpose of considering and acting upon a proposal to sell and convey city -owned land abutting 3900 Alexandria Drive to D & J Investments Inc., and legally described as follows: A part of the Southwest Quarter (SW%) of Section 2, Township 88 North, Range 13 West of the Fifth Principal Meridian, Waterloo, Black Hawk County, Iowa, described as follows: Commencing at the Northeast Corner of Lot 4, Southtown, Waterloo, Black Hawk County, Iowa, said corner also being the Southeast corner of a tract of land described in Land Deeds Book 560 at Page 140 in the office of the Black Hawk County Recorder; thence N 00017130" E along the West line of Alexandra Drive 100.00 feet to the Northeast corner of said tract; thence S 89026130" W 138.73 feet along the North line of said tract and parallel to the North line of Lot 4, Southtown, to the point of beginning; thence S 00017130" W 10.00 feet; thence S 89026130" W 120.00 feet; thence N 00017130" E 10.00 feet to the North line of a tract of land described in Land Deed 560 at Page 143; thence N 89026130" E 120.00 feet along the North line of said tracts described in Land Deed Book 560 at Page 140 and Land Deeds Book 560 at Page 143 to the point of beginning, containing 1200 square feet, and is subject to easements and restrictions of record, all in the City of Waterloo, Black Hawk County, Iowa; for $4,908.00, plus costs. Section 2. That the City Clerk is hereby directed to publish notice of the time and place of said hearing in the Waterloo Courier. PASSED AND ADOPTED this 22nd day of March, 2010. Ernest G.
