HomeMy WebLinkAbout2010-317-05/03/2010RESOLUTION NO. 2010-317 RESOLUTION MAKING ASSESSMENT FOR WORK PERFORMED BY THE WATER WORKS. WHEREAS, the Board of Water Works Trustees of the City of Waterloo, Iowa, did, as provided by law, notify by written notice the property owner of the premises described below to have the repairs completed and further damage prevented, and WHEREAS, the property owner failed to comply with the order of the Board of Water Works Trustees, as by law provided, and WHEREAS, the Board of Water Works Trustees proceeded to have the work done on the premises described below, in the City of Waterloo, Iowa, to comply with Ordinance No. 1118 of the City of Waterloo, Iowa, and WHEREAS, the Board of Water Works Trustees filed with the City Clerk on the 26th day of April, 2010, a report filing claim for the repairs and preventing further damage at the below described premises and same met all the requirements of the City ordinance and have been fully completed. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA, that the said report of the Board of Water Works Trustees be, and the same is hereby, approved; that the work was done under and by virtue hereby, accepted, and that the cost of said work is hereby determined to be as follows, which amount can be assessed over a ten-year period against the property: Patrick A. Heller and Janet L. Heller, Owner 808 Rainbow Drive, Waterloo, Iowa Legal Description: A part of Lots Nos. Five (5) and Six (6) in "Pattison's Subdivision of part of Lot No. 1, ion Auditor's Whitney Road Plat, Black Hawk County, Iowa", (now in the City of Waterloo, Iowa,) bounded as follows: Beginning at a point on the Northeasterly line of Lot No. Five (5) which is Twenty-one (21) feet Southeasterly of the Northwesterly corner of said Lot No. Five (5); thence Southwesterly to a point on the Southwesterly line of Lot No. Six (6) which is Ten (10) feet Northwesterly of the Southeasterly corner of Lot No. Six (6); thence Southeasterly along the Southwesterly lines of Lots Nos. Six (6) and Five (5) to the Southeasterly corner of Lot No. Five (5); thence North along the East Lot line to the Northeasterly corner of Lot No. Five (5); thence Northwesterly along the Northeasterly line of Lot No. Five (5) to the point of beginning, all in the City of Waterloo, Black Hawk County, Iowa. Unpaid Assessment: $639.99 Resolution No. 2010-317 Page 2 Minnie B. Newman, Owner 111 Sherman Avenue, Waterloo, Iowa Legal Description: North Fifty-two ( 52 ) feet of Lot No. Nine ( 9 ) and the North Fifty (50) feet of Lot No. Ten (10) in Auditor Rainbow's Plat of Bicksler's Addition (vacated) and adjoining property unplatted, all in the City of Waterloo, Black Hawk County, Iowa. Unpaid Assessment: $3,832.00 Elmin Djazo, Owner 2519 Lafavette Street, Waterloo, Iowa Leqal Description: Lot 12, Block 14, Blower's Addition, all in the City of Waterloo, Black Hawk County, Iowa. Unpaid Assessment: $2,440.00 BE IT FURTHER RESOLVED that there be, and are hereby assessed and levied a special tax and assessment against the property improved in the City of Waterloo, Iowa, said assessment shall bear interest from the date of levy of the assessment, viz: May 3, 2010, at the rate of nine (9) percent per annum until paid on all the unpaid amount of this assessment certified to the County Treasurer of Black Hawk County, Iowa, and BE IT FURTHER RESOLVED that the City Clerk be, and she is hereby instructed to notify the above described property owners of said property, accordingly and also instructed to certify said assessment to the County Treasurer of Black Hawk County, Iowa, to be entered upon the tax list to be collected as other taxes, as provided by law, and when collected to be credited to the Water Works Fund of said City, and assessment to be made over a ten- year period.
