HomeMy WebLinkAbout2010-336-5 /10/201010 RESOLUTION NO. 2010-336 RESOLUTION AUTHORIZING THE SALE AND CONVEYANCE OF 3.317 ACRES OF EXCESS RIGHT-OF- WAY GENERALLY LOCATED AT THE SOUTHEAST CORNER OF GREENHILL ROAD AND UNIVERSITY AVENUE FOR $61,007.00, PLUS COSTS, AND AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE AND DELIVER DEED FOR SAME AND RESCINDING RESOLUTION NO. 2009-1136 IN ITS ENTIRETY. WHEREAS, the City of Waterloo, Iowa, is the owner of real property in the City of Waterloo, Iowa, as described below, and WHEREAS, an offer to purchase said certain parcels of real property in the sum of $61,007.00, plus costs, has been made by Lockard Land, Inc., and WHEREAS, a public hearing was held on May 10, 2010, at 5:30 p.m. in the Council Chambers in City Hall, Waterloo, Iowa, as provided by law, by the Council of the City of Waterloo, Iowa, on the proposal to sell and convey premises owned by the City of Waterloo, Iowa, to Lockard Land, Inc., and WHEREAS, it is the opinion of this Council that sale and conveyance should be made as proposed. NOW, THEREFORE, IT IS HEREBY RESOLVED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA, AS FOLLOWS: 1. The following described real property, as fully described in the published notice in the Waterloo Courier on May 6, 2010, is not presently needed and will not be needed in the foreseeable future for municipal purposes and its ownership is serving no municipal purpose, and 2. That the offer of Lockard Land, Inc., to purchase real property for the sum of $61,007.00, and costs, be and it is hereby accepted for real property described below: A survey of Parcel "H" of the Southwest quarter (SW 1/) of Section 21, Township 89 North, Range 13 West of the 5th Principal Meridian, in the City of Waterloo, Black Hawk County, State of Iowa, and being more particularly described as follows: Commencing at the intersection of the West line of Alabar Hills Second Addition, City of Waterloo, Black Hawk County, Iowa, and the North right-of-way line of Flower Street; thence N89045'12"W 88.73 feet along the Westerly extension of the North right-of-way line of Flower Street to the Southwest corner of the East 254 feet of the West half (W 34) of the said Southwest quarter (SW 1/) of Section 21 lying North of Flower Street and the point of beginning; thence N00019142"E 150.00 feet along the West line of said East 254 feet of the West half (W %) of the Southwest quarter (SW %) of Section 21, said West line also being the East line of the Southeasterly right-of-way line of South Hackett Road bypass as shown in Misc. Book 266, Page 396; thence N71029'32"W 359.20 feet; thence S30023'49"W 525.49 feet; thence S47008119"E 146.00 feet at right angle to the longest Southeasterly right-of-way line of the South Hackett Road bypass as shown in Misc. Book 266, Page 396; thence N42051141"E 395.00 feet along said longest Southeasterly right-of-way line to the r Resolution 2010-336 Page 2 Westerly extension of the aforesaid North right-of-way line of Flower Street and the East/West line of the said Southeasterly right-of-way line of the South Hackett Road bypass; thence S89045112"E 229.95 feet along said Westerly extension of the North line of Flower Street and East/West line of the Southeasterly right-of-way line of the South Hackett Road bypass to the point of beginning containing 144,473.6 square feet (3.317 acres), all in the City of Waterloo, Black Hawk County, Iowa. 3. That the City of Waterloo, Iowa, convey said parcels of real property to Lockard Land, Inc., by deed. 4. That the Mayor and City Clerk are hereby authorized to execute and deliver deed to Lockard Land, Inc. 5. That the original of said deed fully executed and acknowledged is hereby approved and confirmed by the Council. 6. That the City Clerk is authorized and directed to deliver said deed of conveyance to Lockard Land, Inc., upon receipt of the sum of $61,007.00, and costs. BE IT FURTHER RESOLVED, that Resolution No. 2009-1163, be and the same, hereby rescinded in its entirety. PASSED AND ADOPTED this 1/'est thf May, 2010. Y eaul .
