RESOLUTION NO. 2023-711 RESOLUTION APPROVING THE REQUEST OF JEFFRY SALES FOR A WAIVER FOR A CONCRETE DRIVEWAY, LOCATED AT 133 MARTIN ROAD, WITH THE ELIMINATION OF THE SIDEWALK SECTION DUE TO INABILITY TO MEET GRADE REQUIREMENTS. WHEREAS, the City Engineer has made a written application to the City Council asking that Jeffry Sales, be authorized and permitted to construct a concrete driveway, with the elimination of the sidewalk section due to the inability to meet grade requirements, located at 133 Martin Road and legally described as follows: LOT NO. 2 IN BYRNBRAE REPLAT, WATERLOO, IOWA, EXCEPT A STRIP OF GROUND 15 FEET IN WIDTH OF THE EAST SIDE OF SAID LOT, DESCRIBED AS FOLLOWS: BEGINNING AT THE SOUTHEAST CORNER OF SAID LOT NO. 2, THENCE NORTH ALONG THE EAST LINE OF SAID LOT TO THE NORTHEAST CORNER OF SAID LOT; THENCE WET ALONG THE SOUTHERLY SIDE OF MARTIN STREET 15 FEET; THENCE SOUTH ON A LINE PARALLEL WITH THE EAST LINE OF SAID LOT NO. 2 TO ITS INTERSECTION WITH THE SOUTHEASTERLY LINE OF SAID LOT; THENCE ALONG THE SOUTHEASTERLY LINE OF SAID LOT, IN A NORTHEASTERLY DIRECTION TO THE POINT OF BEGINNING. ALSO A PART OF LOT NO. 3 IN BYRNBRAE REPLAT, WATERLOO, IOWA, DESCRIBED AS FOLLOWS: BEGINNING AT THE SOUTHEASTERLY CORNER OF LOT NO. 3; THENCE NORTH ALONG THE EAST LINE OF SAID LOT TO THE NORTHEASTERLY CORNER OF LOT NO. 3; THENCE WEST ALONG THE SOUTHERLY LINE OF MARTIN STREET 45 FEET; THENCE SOUTH ALONG A LINE PARALLEL WITH THE EAST LINE OF SAID LOT NO. 3 TO ITS INTERSECTION WITH THE SOUTHEASTERLY LINE OF SAID LOT; THENCE IN A NORTHEASTERLY DIRECTION ALONG THE SOUTHEASTERLY LINE OF SAID LOT TO THE POINT OF BEGINNING. AND THAT PART OF THE WEST 30 FEET OF LOT NO. 3 DESCRIBED AS FOLLOWS: BEGINNING AT THE NORTHEAST CORNER OF THE WEST 30.00 FEET OF LOT NO. 3, BYRNBRAE REPLAT, WATERLOO, IOWA, THENCE SOUTH 0 DEGREES EAST 142.67 FEET ALONG THE EAST LINE OF THE WEST 30.00 FEET OF LOT NO. 3 TO THE SOUTHERLY LINE OF LOT NO. 3; THENCE SOUTH 71 DEGREES 24 MINUTES WEST 10.00 FEET ALONG THE SOUTHERLY LINE OF LOT NO. 3; THENCE NORTH 2 DEGREES 32 MINUTES 30 SECONDS EAST 146.02 FEET TO A POINT ON THE NORTH LINE OF LOT NO. 3 WHICH POINT IS 3.00 FEET WEST OF THE POINT OF BEGINNING; THENCE SOUTH 89 DEGREES 37 MINUTES EAST 3.00 FEET TO THE POINT OF BEGINNING IN BYRNBRAE REPLAT, WATERLOO, IOWA. WHEREAS, it is the sense of the Council of the City of Waterloo, Iowa, that said request should be granted. NOW, THEREFORE, BE IT FURTHER RESOLVED that permission is hereby granted to Jeffry Sales, to construct a concrete driveway, with the elimination of the sidewalk section due to the inability to meet grade requirements, located at 133 Martin Road subject to the following Resolution 2023-711 Page 2 conditions: 1. Work is to be performed by an approved and bonded contractor. 2. A permit is to be obtained from the office of the City Engineer prior to construction. 3. All work shall be under the supervision of the City Engineer and at no cost to the City of Waterloo. BE IT FURTHER RESOLVED, that the City Clerk is authorized and directed to forward a certified copy of this resolution to the Black Hawk County Recorder for recording and the Black Hawk County Auditor for filing in order that this said action may become a matter of official County Record.
