HomeMy WebLinkAbout2010-1014-11/15/2010RESOLUTION NO. 2010-1014 RESOLUTION AUTHORIZING THE SALE AND CONVEYANCE OF APPROXIMATELY 1.13 ACRES OF CITY -OWNED PROPERTY GENERALLY LOCATED AT THE NORTHWEST CORNER OF 18TH STREET AND BLACK HAWK STREET FOR $1.00, PLUS COSTS, AND AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE AND DELIVER DEED FOR SAME. WHEREAS, the City of Waterloo, Iowa, is the owner of real property in the City of Waterloo, Iowa, as described below, and WHEREAS, an offer to purchase said certain parcels of real property in the sum of $1.00, plus costs, has been made by Failor Hurley Properties, LLC, and WHEREAS, a public hearing was held on November 15, 2010, at 5:30 p.m. in the Council Chambers in City Hall, Waterloo, Iowa, as provided by law, by the Council of the City of Waterloo, Iowa, on the proposal to sell and convey premises owned by the City of Waterloo, Iowa, to Failor Hurley Properties, LLC, and WHEREAS, it is the opinion of this Council that sale and conveyance should be made as proposed. NOW, THEREFORE, IT IS HEREBY RESOLVED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA, AS FOLLOWS: 1. The following described real property, as fully described in the published notice in the Waterloo Courier on November 9, 2010, is not presently needed and will not be needed in the foreseeable future for municipal purposes and its ownership is serving no municipal purpose, and 2. That the offer of Failor Hurley Properties, LLC to purchase real property for the sum of $1.00, and costs, be and it is hereby accepted for real property described below: A survey of Parcel "F" as shown on Plat of Survey Doc. #2007 014335, that part of Lots 1 and 10 and the vacated alley in Block 15 of Hayes' Addition lying east of said Parcel "F" and south of the southwesterly line described in City Lot Deed Book 545 at Page 381 and vacated West 17th Street lying northwesterly of Black Hawk Street and southwesterly of that portion of West 17th Street vacated in Miscellaneous Book 83 at Page 168, in the City of Waterloo, Black Hawk County, Iowa, and being further described as follows: Beginning at the southeasterly corner of said Block 15, being the intersection of the northerly line of Black Hawk Street and the westerly line of West 18th Street; thence North 40045'47" East 224.50 feet along the easterly line of Block 15 to the southeasterly corner of the parcel described in City Lot Deed Book 545 at Page 381, said corner being 73 feet northeasterly of the southeasterly corner of Lot 1; thence North 40°14'30" West 304.70 feet along the southwesterly line of the parcel described in City Lot Deed Book 545 at Page 381 to a point on the westerly line Lot 5, 12.4 feet southwesterly of the northwesterly corner of said Lot 5; thence North 40°50'58" East 12.40 feet to the said northwesterly corner of Lot 5; thence North 48°55'42" West 65.98 feet to the Northeasterly corner of Block 16, Hayes Addition, said corner being the Resolution No. 2010-1014 Page 2 intersection of the westerly line of West 17th Street and the southerly line of River Street; thence South 40050'06" West 283.53 feet along the easterly line of Block 16 to the southeasterly corner of Block 16, said corner being the intersection of the westerly line of West 17th Street and the northerly line of Black Hawk Street; thence South 49001'25" East 65.94 feet to the southwesterly corner of Block 15 in Hayes' Addition, said corner being the intersection of the easterly line of West 17th Street and the northerly line of Black Hawk Street; thence continuing South 49001125" East 227.28 feet along the southerly line of said Block 15 to the point of beginning containing 93,315 square feet (2.14 acres) and reserving an easement over, under and across the Westerly 66 feet of the described parcel (formerly West 17th Street) for utility installation and maintenance, all in the City of Waterloo, Black Hawk County, Iowa; for $1.00, plus costs. 3. That the City of Waterloo, Iowa, convey said parcels of real property to Failor Hurley Properties, LLC by deed. 4. That the Mayor and City Clerk are hereby authorized to execute and deliver deed to Failor Hurley Properties, LLC. 5. That the original of said deed fully executed and acknowledged is hereby approved and confirmed by the Council. 6. That the City Clerk is authorized and directed to deliver said deed of conveyance to Failor Hurley Properties, LLC upon receipt of the sum of $1.00, and costs.
