ORDINANCE NO. 5749 AN ORDINANCE AMENDING THE CITY OF WATERLOO CODE OF ORDINANCES BY AMENDING TITLE 5, POLICE REGULATIONS, CHAPTER 1, ANIMAL CONTROL, ARTICLE B, DANGEROUS ANIMALS AND REGULATED DOGS, SECTION 5-1B-9, DOG ATTACKS. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WATERLOO, IOWA AS FOLLOWS: Section 1. That Title 5, Police Regulations, Chapter 1, Animal Control, Article B, Dangerous Animals and Regulated Dogs, Section 5-1B-9, Dog Attacks is amended by removing the term "At Large" from the ordinance and replacing the term "apprehended" with seized, to read as follows: 5-1B-9: DOG ATTACKS: In the event of an attack on a person or a domestic animal by a dog that was previously determined to be a vicious dog or that is determined to be a vicious dog as a result of such an attack, the dog shall be seized by animal control. The dog will be tested for rabies and may be destroyed by the city without further action or possibility of appeal. The owner or caretaker will be charged all fees and charges incurred as set forth in subsection 5-1-1E of this chapter and all costs incident to the destruction of the dog. Section 2. This ordinance shall be in full force and effect from and after its passage and publication as provided by law.
