HomeMy WebLinkAbout2010-860-10/04/2010RESOLUTION NO. 2010-860 RESOLUTION FIXING THE TIME AND PLACE OF HEARING AND NOTICE TO BE GIVEN ON THE REQUEST TO VACATE, SELL AND CONVEY APPROXIMATELY 2.48 ACRES OF VARIOUS PORTIONS OF RIGHT-OF-WAY GENERALLY LOCATED ON LOWELL AVENUE BETWEEN REGAL AVENUE AND EAST MITCHELL AVENUE, AS WELL AS LOWELL AVENUE PLATTED RIGHT-OF-WAY LYING SOUTH OF EAST MITCHELL AVENUE, AS WELL AS MULTIPLE ALLEYS BORDERING THE CURRENT SALVAGE YARD TO PAT'S AUTO SALVAGE AT A COST OF $3,375.60, AS OCTOBER 4, 2010, AT 5:30 P.M. IN CITY HALL COUNCIL CHAMBERS, WATERLOO, IOWA, AND INSTRUCTING THE CITY CLERK TO PUBLISH THE NOTICE OF HEARING. BE IT RESOLVED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA, AS FOLLOWS: Section 1. That the Council of the City of Waterloo, Iowa, shall meet at City Hall Council Chambers in the City of Waterloo, Iowa, at 5:30 p.m. on the 4th day of October, 2010, for the purpose of considering and acting upon the request to vacate, sell and convey approximately 2.48 acres of various portions of right-of-way generally located on Lowell Avenue between Regal Avenue and East Mitchell Avenue, as well as Lowell Avenue platted right-of-way lying south of East Mitchell Avenue, as well as multiple alleys bordering the current salvage yard to Pat's Auto Salvage, and legally described as follows: That part of the fifty (50) foot wide public Lowell Avenue as platted in Riverview Addition that lies Southeasterly of the Northeasterly extension of the Northwesterly line of Lot 60 of Block 108 of said addition and Northwesterly of a line drawn between the Southeast corner of Lot 33 of Block 108 of said addition and the Southwest corner of Lot 31 of Block 109 of said addition, subject to city's retention of a permanent utility easement over, under and upon the described area; And also; That part of the fifty (50) foot wide platted Lowell Avenue right-of-way that lies Southeasterly of a line drawn between the Northeast corner of Lot 17 of Riverview Addition and the Northwest corner of Lot 26 of Sheffield Addition and Northwesterly of a line drawn between the Northeast corner of Lot A of Block 111 of Riverview Addition and the Northwest corner of Lot A of Block 112 of Riverview Addition; And also; That part of the ten (10) foot wide public alley as platted in Block 109 of Riverview Addition that lies Southeasterly of the Northeasterly extension of the Northwesterly line of Lot 9 of Block 109 of said addition and Northwesterly of the Easterly extension of the South line of Lot 32 of Block 109 of said addition; And also; That part of the ten (10) foot wide public alley as platted in Sheffield Addition that lies Southeasterly Resolution 2010-860 Page 2 of a line drawn between the Northeast corner of Lot 1 of said addition and the Northwest corner of Lot 2 of said addition and Northwesterly of a line drawn between the Southeast corner of Lot 1 of said addition and the Southwest corner of Lot 7 of said addition; And also; That part of the sixteen (16) foot wide platted alley that lies East of a line drawn between the Southwest corner of Lot 16 of Sheffield Addition and the Northwest comer of Lot 1 of Block 111 of Riverview Addition and West of a line drawn between the Southeast corner of Lot 25 of Sheffield Addition and the Northeast corner of Lot A of Block 111 of Riverview Addition. And also; Part of the Southwest Quarter of Section 31, Township 89 North, Range 12 West of the 5th Principal Meridian in the City of Waterloo, Black Hawk County, Iowa described as follows: Beginning at the Northeast corner of Sheffield Addition to the City of Waterloo, said point being on the Northerly terminus of the East line of a 10 foot wide alley; thence S 89057'32" E 113.06 feet along the South line of Mitchell Avenue; thence S 26°29116" E 229.58 feet to the North line of Parcel "B" recorded as Document No. 2006 15234 in the records of Black Hawk County; thence N 89055106" W 137.91 feet along said North line to the said East line of said 10 foot wide alley; thence N 20041'16" W 219.62 feet along the East line of said alley to the point of beginning, containing 0.591 acres, all in the City of Waterloo, Black Hawk County, Iowa; for $3,375.60, plus costs, subject to the retention of a utility easement over, under, and upon the portion as needed. Section 2. That the City Clerk is hereby directed to publish notice of the time and place of said hearing in the Waterloo Courier.
