RESOLUTION NO. 2024-146
RESOLUTION AUTHORIZING THE SALE AND
CONVEYANCE OF CITY -OWNED PROPERTY LOCATED
NORTH OF 216 SUNNYSIDE AVENUE, IN THE AMOUNT OF
$1.00 TO IOWA HEARTLAND HABITAT FOR HUMANITY,
AND AUTHORIZING THE MAYOR AND CITY CLERK TO
EXECUTE SAID DOCUMENTS.
WHEREAS, the City of Waterloo, Iowa is the owner of property located north of 216
Sunnyside Avenue, in the City of Waterloo, Iowa, and legally described as follows:
NORTH 35 FEET IN WIDTH OF THE SOUTH 70 FEET IN WIDTH OF LOT
5, BLOCK 2, "OAK LAWN ADDITION" IN WATERLOO, IOWA AND PART
OF THE STREET ADJOINING SAID LOT DESCRIBED AS: COMMENCING
AT A POINT ON THE EAST LINE OF SAID LOT 5, 35 FEET NORTH OF
THE SOUTHEAST CORNER OF SAID LOT; THENCE EAST 3 FEET;
THENCE NORTH PARALLEL WITH THE EAST LINE OF SAID LOT 35
FEET; THENCE WEST 3 FEET TO THE EAST LINE OF SAID LOT;
THENCE SOUTH TO THE PLACE OF BEGINNING.
AND
SOUTH 35 FEET OF LOT 5 IN BLOCK 2 IN "OAK LAWN ADDITION" IN
WATERLOO, IOWA, AND A PART OF THE VACATED STREET
ADJOINING DESCRIBED AS FLOWS: BEGINNING AT THE SOUTHEAST
CORNER OF SAID LOT; THENCE EAST 3 FEET; THENCE NORTH
PARALLEL WITH THE EAST LINE OF SAID LOT 35 FEET; THENCE
WEST 3 FEET TO THE EAST LINE OF SAID LOT; THENCE SOUTH
ALONG SAID EAST LINE 35 FEET TO THE POINT OF BEGINNING
WHEREAS, an offer to purchase said city -owned property, in the amount of $1.00 has
been made by Iowa Heartland Habitat for Humanity, and
WHEREAS, a public hearing was held on March 18, 2024, at 5:30 p.m. in the Harold E.
Getty Council Chambers, City Hall, Waterloo, Iowa, as provided by law, by the Council of the
City of Waterloo, Iowa, on the proposal to sell and convey premises owned by the City of
Waterloo, Iowa, to Iowa Heartland Habitat for Humanity, and
WHEREAS, it is the opinion of this Council that the sale and conveyance should be made
as proposed.
NOW, THEREFORE, IT IS HEREBY RESOLVED BY THE COUNCIL OF THE CITY
OF WATERLOO, IOWA, AS FOLLOWS:
1. The city -owned property located north of 216 Sunnyside Avenue, in the City of
Waterloo, Iowa, as fully described in the published notice in the Waterloo Courier on March 9,
2024, is not presently needed, and will not be needed in the foreseeable future for municipal
purposes, and its ownership is serving no municipal purpose.
2. That the offer of Iowa Heartland Habitat for Humanity to purchase the city -owned
property, located north of 216 Sunnyside Avenue, in the amount of $1.00, is hereby accepted for
said property.
3. That the City of Waterloo, Iowa conveys said parcels of real property to Iowa
Heartland Habitat for Humanity, by quit claim deed.

4. That the Mayor and City Clerk are authorized and directed to execute said deed.
5. That the original of said quit claim deeds, fully executed and acknowledged, are
hereby approved and confirmed by this Council.
6. That the Community Planning and Development Director is authorized and directed to
deliver said deed of conveyance to Iowa Heartland Habitat for Humanity, upon execution of said
document and receipt of payment of $1.00.
