HomeMy WebLinkAbout2010-909-10/04/2010RESOLUTION NO. 2010-909 RESOLUTION ACCEPTING AND APPROVING CERTAIN ACQUISITION CONTRACT TO SELL REAL PROPERTY TO THE CITY AND ACCEPTING AND APPROVING CERTAIN DEED IN CONJUNCTION WITH THE HAZARD MITIGATION GRANT PROGRAM PROPERTY ACQUISITION PROJECT. WHEREAS, the City of Waterloo, Iowa, has had the parcel described herein appraised and the fair market value ascertained, and WHEREAS, the acquisition of the hereinafter described parcel is in conjunction with the Hazard Mitigation Grant Program Property Acquisition Project. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WATERLOO, IOWA, that the contract for the parcel hereinafter described to sell the same to the City of Waterloo, Iowa, all of which is situated in the City of Waterloo, Black Hawk County, Iowa, is accepted and approved and the Mayor and City Clerk are authorized and directed to execute the same in behalf of the City and to execute all instruments necessary to consummate the agreement to purchase the property from the owners thereof, and the deed for the conveyance of the same is also accepted and approved and the City of Waterloo is directed to pay for the property from City funds. The subject address is: Owner - James R. Hackett Address - 180 Sans Souci Drive Total Acquisition - $183,400.00 less deductions for duplication of benefits Legally described as follows: Lots Nos. One (1), Two (2) and Three (3) in First Addition to Sans Souci, in the City of Waterloo, Black Hawk County, Iowa, together with the following described property lying between the said lots and the Cedar River as follows: Beginning at the intersection of the Easterly line of Lots Nos. Twenty (20) and Twenty-one (21) in Sans Souci produced Northerly and the Southerly line of said Lot No. One (1) produced Easterly; thence Northerly along a line that is parallel with the Easterly line of said Lots Nos. One (1), Two (2) and Three (3) to its intersection with the Northerly line of said Lot No. Three (3) produced Easterly; thence Westerly along the extension Easterly of the Northerly line of said Lot No. Three (3) to the Northeasterly corner of said Lot No. Three (3); thence Southerly along the Easterly line of said Lot No. One (1) to the Southeasterly corner of said Lot No. One (1); thence Easterly along an extension of the Southerly line of said Lot No. One (1) to the point of beginning. Also that part of Wangler Street as platted in First Addition to Sans Souci, described as follows: Beginning at the Southwesterly Corner of Lot No. One (1), in said First Addition to Sans Souci; running thence East along the North line of Wangler Street to the Southeasterly Corner of said Lot No. One (1) thence Resolution No. 2010-909 Page 2 Southeasterly along an Extension of the East line of said Lot No. One (1) a distance of Twenty and Twenty- five Hundredths (20.25) feet, more or less, to the North line of Lot No. Twenty-one (21) in Sans Souci; thence West along the North line of said Lot No. Twenty-one (21) and an extension thereof to a point in the extension Southerly of the West line of said Lot No. One (1); thence running Northwesterly along the extension Southerly of the Westerly line of said Lot No. One (1) a distance of Twenty and Twenty-five Hundredths (20.25) feet more or less to the point of beginning, all in the City of Waterloo, Black Hawk County, Iowa.
