RESOLUTION APPROVING RELEASE CLAIM FOR DC
CORPORATION OF WATERLOO, IOWA, IN THE AMOUNT
OF $25,000.00, AND DIRECTING EXECUTION OF
SAID RELEASE CLAIM BY MAYOR.
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA:
That payment of $25,000.00 fully releases and forever
discharges DC Corporation from any and all causes of action that
the City has or may have, including any claims for injury to
others, arising out of DC Corporation's acts or omissions in
damaging the City's traffic signal loops, conduits and electrical
facilities during excavation in the vicinity of Park Avenue and
Bluff Street on or about May 6, 2009 when the accident occurred,
and the Mayor and City Clerk are hereby authorized to execute.
said Release Claim on behalf of the City of Waterloo, Iowa.
PASSED AND ADOPTED thi.s 11th day of October, 2010.
