RESTRICTIVE COVENANT

located in the City of Waterloo, Black Hawk County, Iowa, commonly known as 257 E Airline
Highway , and legally described as (and hereinafter referred to as Lot A):
The South Ten (10) acres of the West Twenty (20) acres of the East One-half of the Southwest Quarter
of Section No. One (1), Township No. Eighty-nine (89) North, Range No. Thirteen (13) West of the
Fifth Principal Meridian in Black Hawk County, Iowa.
herein state that I (we) have purchased the adjacent lot(s), legally described as (and hereinafter referred
to as Lot B):
The part of the West One-half of the Southwest Quarter of Section No. 1, Township No. 89 North,
Range No. 13, West of the Fifth Principal Meridian, in the City of Waterloo, Black Hawk County
Iowa, described as follows:
Beginning at the Southeast Corner of the West One-Half of the Southwest Quarter of said Section;
thence North along the East line of said West One-half to a point in a line which is 660 feet South of
the North line of the Southwest Quarter of said Section, thence West along said line to a point in a line
which is 300 feet East of the centerline of the paving on Primary Highway No. 63, as located on
February 6, 1967; thence South along said line to a point in which is 660 feet North of the South line of
the Southwest Quarter of said Section; thence East along said line to a point in a line which is 200 feet
West of the East line of the West One-half of the Southwest Quarter of Said Section; thence South
along said line to the South line of said Section; thence East along the South line of said Section a
distance of 200 feet to the point of the beginning. Except that part shown as Parcel "A" of the Plat
Survey in Misc 302-667
for the purpose of maintaining the minimum lot size of 35 acres in the "A-1" Agricultural District
in association with a principal permitted use. As a result of said purchase, I (we) herein declare that the
following restrictive covenants shall govern the use of Lot B, which restrictions shall run with the land
and be binding on the successors, heirs and assigns:
1. That Lot B shall not be sold individually or subdivided unless there is 35 acres tied to the principal
permitted use and the accessory structures on Lot A.
2. That this restrictive covenant, as mentioned in Paragraph 1, shall not apply if both Lots A and B are
sold as a unified parcel.
3. That these restrictive covenants have been placed on the real property in order to comply with the
requirements of the Zoning Ordinance of the City of Waterloo.
4. That none of these restrictive covenants shall be rescinded without the express written consent of
the City Planner or his/her authorized designee.
