RESOLUTION NO. 2024-229 RESOLUTION ACCEPTING A PUBLIC SIDEWALK EASEMENT AGREEMENT FROM THE WATERLOO COMMUNITY SCHOOL DISTRICT TO ALLOW FOR THE PLACEMENT OF A PUBLIC SIDEWALK ALONG WESTERN AVENUE ON THE SCHOOL-OWNED PROPERTY, LOCATED AT 1115 WEST 5TH STREET (IRVING ELEMENTARY SCHOOL). WHEREAS, the Public Sidewalk Easement Agreement, with the Waterloo Community School District, of the hereinafter described parcel is to allow for the placement of a public sidewalk along Western Avenue on the school-owned property, located at 1115 West 5th Street (Irving Elementary School), and WHEREAS, the sidewalk easement is valued at $1.00, and is to be paid by the City of Waterloo to the Waterloo Community School District in consideration of said perpetual Easement for public sidewalk right-of-way, under, over, through, and across hereinafter described parcel. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WATERLOO, IOWA, that the Public Sidewalk Easement Agreement, in the amount of$1.00, between the Waterloo Community School District and the City of Waterloo, Iowa, for the placement of a public sidewalk along Western Avenue on the school-owned property, located at 1115 West 5th Street(Irving Elementary School), is accepted and approved. THAT PART OF VACATED WESTERN AVENUE RIGHT OF WAY ADJACENT TO BLOCK 5, LEAVITT, JOHNSON AND MILLER ADDITION, WATERLOO, BLACK HAWK COUNTY, IOWA DESCRIBED AS FOLLOWS: COMMENCING AT THE SOUTHWEST CORNER OF SAID BLOCK 5; THENCE SOUTH 89 DEGREES 23 MINUTES 56 SECONDS WEST, ON THE WESTERLY EXTENSION OF THE SOUTH LINE OF SAID BLOCK 5, A DISTANCE OF 11.20 FEET TO THE POINT OF BEGINNING; THENCE CONTINUE SOUTH 89 DEGREES 23 MINUTES 56 SECONDS WEST, ON SAID SOUTH LINE, 10.00 FEET; THENCE NORTH 01 DEGREES 51 MINUTES 33 SECONDS WEST, 299.96 FEET TO A POINT ON THE WESTERLY EXTENSION OF THE NORTH LINE OF SAID BLOCK 5; THENCE NORTH 89 DEGREES 22 MINUTES 21 SECONDS EAST, ON SAID NORTH LINE, 10.00 FEET; THENCE SOUTH 01 DEGREES 51 MINUTES 33 SECONDS EAST, 299.96 FEET TO THE POINT OF BEGINNING PASSED AND ADOPTED this 1511i day of April 2024.
