FOR CITY -OWNED PROPERTY
This Amendment (the "Amendment") is entered into as of May 6 2024 by
and between the City of Waterloo, Iowa ("City") and Luke Weston ("Lessee").
WHEREAS, City and Lessee are parties to that certain Lease Agreement for City -Owned
Property dated My , 2020 (the "Lease") concerning real property described therein; and
WHEREAS, the parties desire to amend the Lease on the terms set forth herein.
NOW, THEREFORE, in consideration of the mutual covenants and promises contained
herein, and for other good and valuable consideration, the receipt and sufficiency of which is
hereby acknowledged, the parties agree as follows:
1. The Lease is amended to provide that Lessee shall, in 2024, undertake earthwork
on the Property to reshape drainageways in accordance with plans approved in advance by the
City Engineer, including appropriate seeding of any drainageway soil disturbed by the work.
The parties intend that such work will help to reduce erosion of tillable soil and improve surface
water drainage. All work performed by Lessee shall be subject to inspection and approval by the
City Engineer, with appropriate remedial measures taken as specified by the City Engineer,
before the work will be accepted as final and complete. The documented cost of such work, not
to exceed $8,500.00, shall be deducted from rent payable for the 2024 crop year.
2. Except to the extent amended by this instrument, the Lease shall continue
unmodified in full force and effect. The Lease and this Amendment are binding upon and shall
inure to the benefit of the parties and their respective successors and assigns.
IN WITNESS WHEREOF, the parties have executed this Amendment to Lease
Agreement for City -Owned Property by their duly authorized representatives as of the date first
set forth above.
