RESOLUTION NO. 2024-280
RESOLUTION APPROVING THE REAL ESTATE PURCHASE
AGREEMENT AND TEMPORARY CONSTRUCTION
EASEMENT AGREEMENT WITH PRIME RE, LLC, FOR
PROPERTIES LOCATED NORTH OF 2323 LA PORTE ROAD,
SOUTH OF 2134 LA PORTE ROAD, AND NORTH OF 2134 LA
PORTE ROAD, IN THE AMOUNT OF $5,553.49 PLUS UP TO
$2,000.00 IN CLOSING COSTS, IN CONJUNCTION WITH
THE LA PORTE ROAD RECONSTRUCTION PROJECT, AND
AUTHORIZING THE MAYOR AND CITY CLERK TO
EXECUTE SAID DOCUMENTS.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WATERLOO,
IOWA, AS FOLLLOLWS:
1. That the Real Estate Purchase Agreement dated May 6, 2024, between Prime RE,
LLC and the City of Waterloo, Iowa, in the amount of $5,553.49 plus up to $2,000.00 in closing
costs, for properties located north of 2323 La Porte Road, South of 2134 La Porte Road, and
North of 2134 La Porte Road, and legally described as follows:
DESCRIPTION: ACQUISITION PROJECT PARCEL LPR107
A PARCEL OF LAND SITUATED IN PART PARCEL "B" IN
GOVERNMENT LOT 6, SECTION 1, TOWNSHIP 88 NORTH, RANGE
13 WEST OF THE 5TH P. M., CITY OF WATERLOO, COUNTY OF
BLACK HAWK, STATE OF IOWA, MORE PARTICULARLY
DESCRIBED AS FOLLOWS:
BEGINNING AT THE MOST NORTHERLY CORNER OF SAID

2. That the Temporary Easement Agreement between Prime RE, LLC and the City
of Waterloo, Iowa, for purposes relating to the construction of the improvements in, to, upon,
over across, and beneath said real estate as set forth in Exhibit "A", to expire upon the
conclusion of all construction, cleanup, and demobilization activities upon the premises and
adjacent land, or December 31, 2025, whichever occurs first, is hereby approved.
3. That the Mayor and City Clerk are authorized and directed to execute said
documents on behalf of the City of Waterloo, Iowa.
