RESOLUTION NO. 2024-283
RESOLUTION APPROVING THE REAL ESTATE PURCHASE
AGREEMENT AND TEMPORARY CONSTRUCTION
EASEMENT AGREEMENT WITH SHRI GAYATRI MA, INC.,
FOR PROPERTY LOCATED SOUTH OF 2056 LA PORTE
ROAD, IN THE AMOUNT OF $100.00 PLUS UP TO $2,000.00
IN CLOSING COSTS, IN CONJUNCTION WITH THE LA
PORTE ROAD RECONSTRUCTION PROJECT, AND
AUTHORIZING THE MAYOR AND CITY CLERK TO
EXECUTE SAID DOCUMENTS.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WATERLOO,
IOWA, AS FOLLLOLWS:
1. That the Real Estate Purchase Agreement dated May 6, 2024, between Shri
Gayatri Ma, Inc. and the City of Waterloo, Iowa, in the amount of $100.00 plus up to $2,000.00
in closing costs, for property located south of 2056 La Porte Road, and legally described as
follows:
DESCRIPTION: ACQUISITION PROJECT PARCEL LPR122
A PARCEL OF LAND SITUATED IN PART OF PARCEL "N", WHICH
IS PART OF TRACT "XG" OF CROSSROADS PLAT NO. 1
(RECORDED IN DOCUMENT NO. 2013-00025983 IN THE OFFICE
OF THE BLACK HAWK COUNTY RECORDER), CITY OF
WATERLOO, COUNTY OF BLACK HAWK, STATE OF IOWA,
MORE PARTICULARLY DESCRIBED AS FOLLOWS:
BEGINNING AT THE EASTERLY MOST CORNER OF SAID
PARCEL "N", WHICH IS AT THE INTERSECTION OF THE
PRESENT SOUTHWESTERLY RIGHT-OF-WAY LINE OF LA PORTE
ROAD AND THE PRESENT NORTHWESTERLY RIGHT-OF-WAY
LINE OF BOPP STREET; THENCE SOUTH 54°58'37" WEST
(ASSUMED BEARING FOR THE PURPOSE OF THIS DESCRIPTION)
ALONG THE SOUTHEASTERLY LINE OF SAID PARCEL "N",
ALSO BEING THE PRESENT NORTHWESTERLY RIGHT-OF-WAY
LINE OF BOPP STREET, 8.42 FEET; THENCE NORTH 09°29'39"
WEST, 19.54 FEET TO THE NORTHEASTERLY LINE OF SAID
PARCEL "N", ALSO BEING THE PRESENT SOUTHWESTERLY
RIGHT-OF-WAY LINE OF LA PORTE ROAD; THENCE SOUTH
35°01'23" EAST ALONG THE NORTHEASTERLY LINE OF SAID
PARCEL "N", ALSO BEING THE PRESENT SOUTHWESTERLY
RIGHT-OF-WAY LINE OF LA PORTE ROAD, 17.63 FEET TO THE
POINT OF BEGINNING.
CONTAINING 74 SQUARE FEET.
is hereby approved.
2. That the Temporary Easement Agreement between Shri Gayatri Ma, Inc. and the
City of Waterloo, Iowa, for purposes relating to the construction of the improvements in, to,
upon, over across, and beneath said real estate as set forth in Exhibit "A", to expire upon the
conclusion of all construction, cleanup, and demobilization activities upon the premises and
adjacent land, or December 31, 2025, whichever occurs first, is hereby approved.

3. That the Mayor and City Clerk are authorized and directed to execute said
documents on behalf of the City of Waterloo, Iowa.
