RESOLUTION NO. 2024-285
RESOLUTION APPROVING A PERMANENT EASEMENT
AGREEMENT AND TEMPORARY CONSTRUCTION
EASEMENT AGREEMENT WITH BAMBOO RIDGE
CAMPGROUND INC., FOR PROPERTY LOCATED AT 4550
LA PORTE ROAD, IN THE AMOUNT OF $1,100.06, IN
CONJUNCTION WITH THE LA PORTE ROAD
RECONSTRUCTION PROJECT, AND AUTHORIZING THE
MAYOR AND CITY CLERK TO EXECUTE SAID
DOCUMENTS.
WHEREAS, the Permanent Stormwater Easement Agreement and Temporary Easement
Agreement of the hereinafter described parcel is to allow for the construction of a storm sewer
and surface drainage of storm water, and
WHEREAS, the permanent easement is valued at $1,100.06, and Bamboo Ridge
Campground, Inc., has agreed to be compensated in that amount.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
WATERLOO, IOWA, that the Permanent Easement Agreement and Temporary Easement
Agreement between Bamboo Ridge Campground, Inc., and the City of Waterloo, Iowa for the
hereinafter described parcel, is accepted and approved and the Mayor and City Clerk are
authorized and directed to execute said documents on behalf of the City of Waterloo, Iowa.
DESCRIPTION: PERMANENT EASEMENT PROJECT PARCEL LPR104
A PARCEL OF LAND SITUATED IN PART OF PARCEL "C" (RECORDED
IN DOCUMENT NO. 2020-00022776) THAT IS LOCATED IN THE
SOUTHEAST 1/4 AND THE NORTHEAST 1/4 OF SECTION 11, TOWNSHIP
88 NORTH, RANGE 13 WEST OF THE 5TH P.M., CITY OF WATERLOO,
COUNTY OF BLACK HAWK, STATE OF IOWA, MORE PARTICULARLY
DESCRIBED AS FOLLOWS:
COMMENCING AT THE SOUTHEAST CORNER OF SAID SECTION 11;
THENCE NORTH 00°27'30" EAST (ASSUMED BEARING FOR THE
PURPOSE OF THIS DESCRIPTION) ALONG THE EAST LINE OF THE
SOUTHEAST 1/4 OF SAID SECTION 11, A DISTANCE OF 1383.39 FEET;
THENCE NORTH 89°32'30" WEST, 60.04 FEET TO THE PRESENT
WESTERLY RIGHT-OF-WAY LINE OF HESS ROAD BEING THE POINT
OF BEGINNING; THENCE CONTINUING NORTH 89°32'38" WEST, 20.00
FEET; THENCE NORTH 00°27'30" EAST, 70.00 FEET; THENCE SOUTH
89°32'30" EAST, 20.00 FEET TO THE PRESENT WESTERLY RIGHT-OF-
WAY LINE OF HESS ROAD; THENCE SOUTH 00°27'30" WEST ALONG
THE PRESENT WESTERLY RIGHT-OF-WAY LINE OF HESS ROAD, 70.00
FEET TO THE POINT OF BEGINNING.
CONTAINING 1,400 SQUARE FEET OR 0.03 ACRES.
TEMPORARY EASEMENT DESCRIPTION:
A TEMPORARY EASEMENT FOR PURPOSES RELATING TO THE
CONSTRUCTION OF THE IMPROVEMENTS IN, TO, UPON, OVER,
ACROSS, AND BENEATH THE REAL ESTATE AS SET FORTH ON
