RESOLUTION NO. 2024-287 RESOLUTION APPROVING A PERMANENT EASEMENT AGREEMENT AND TEMPORARY CONSTRUCTION EASEMENT AGREEMENT WITH TD PROPERTIES, LLC, FOR PROPERTY LOCATED AT 2213 LA PORTE ROAD, IN THE AMOUNT OF $2,821.58, IN CONJUNCTION WITH THE LA PORTE ROAD RECONSTRUCTION PROJECT, AND AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE SAID DOCUMENTS. WHEREAS, the Permanent Easement Agreement and Temporary Easement Agreement of the hereinafter described parcels is to allow for the construction of a storm sewer and surface drainage of storm water, and WHEREAS, the permanent easement is valued at $2,821.58, and TD Properties, LLC, has agreed to be compensated in that amount. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WATERLOO, IOWA, that the Permanent Easement Agreement and Temporary Easement Agreement between TD Properties, LLC and the City of Waterloo, Iowa for the hereinafter described parcels, is accepted and approved and the Mayor and City Clerk are authorized and directed to execute said documents on behalf of the City of Waterloo, Iowa. DESCRIPTION: PERMANENT EASEMENT PROJECT PARCEL LPR110 A PARCEL OF LAND SITUATED IN PART LOT 13 OF MURPHY SUBDIVISION, CITY OF WATERLOO, COUNTY OF BLACK HAWK, STATE OF IOWA MORE PARTICULARLY DESCRIBED AS FOLLOWS: COMMENCING AT THE WESTERLY MOST CORNER OF SAID LOT 13; THENCE NORTH 54°55'55" EAST (ASSUMED BEARING FOR THE PURPOSE OF THIS DESCRIPTION) ALONG THE NORTHWESTERLY LINE OF SAID LOT 13, A DISTANCE OF 12.00 FEET TO THE PRESENT NORTHEASTERLY RIGHT-OF-WAY LINE OF LA PORTE ROAD, BEING THE POINT OF BEGINNING; THENCE CONTINUING NORTH 54°55'55" EAST ALONG THE NORTHWESTERLY LINE OF SAID LOT 13, A DISTANCE OF 7.00 FEET; THENCE SOUTH 32°32'54" EAST, 40.04 FEET; THENCE SOUTH 54°55'55" WEST, 5.00 FEET TO THE PRESENT NORTHEASTERLY RIGHT-OF-WAY LINE OF LA PORTE ROAD; THENCE NORTH 35°24'14" WEST ALONG THE PRESENT NORTHEASTERLY RIGHT-OF-WAY LINE OF LA PORTE ROAD, 40.00 FEET TO THE POINT OF BEGINNING. CONTAINING 240 SQUARE FEET. TEMPORARY EASEMENT DESCRIPTION: A TEMPORARY EASEMENT FOR PURPOSES RELATING TO THE CONSTRUCTION OF THE IMPROVEMENTS IN, TO, UPON, OVER, ACROSS, AND BENEATH THE REAL ESTATE AS SET FORTH ON EXHIBIT "A".
