RESOLUTION NO. 2024-288
RESOLUTION APPROVING A PERMANENT EASEMENT
AGREEMENT AND TEMPORARY CONSTRUCTION
EASEMENT AGREEMENT WITH CROSSROAD FORD, LTD,
FOR PROPERTY LOCATED SOUTH OF 2033 LA PORTE
ROAD, IN THE AMOUNT OF $2,532.77, IN CONJUNCTION
WITH THE LA PORTE ROAD RECONSTRUCTION PROJECT,
AND AUTHORIZING THE MAYOR AND CITY CLERK TO
EXECUTE SAID DOCUMENTS.
WHEREAS, the Permanent Easement Agreement and Temporary Easement Agreement
of the hereinafter described parcels is to allow for the construction of a storm sewer and surface
drainage of storm water, and
WHEREAS, the permanent easement is valued at $2,532.77, and Crossroad Ford, LTD,
has agreed to be compensated in that amount.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
WATERLOO, IOWA, that the Permanent Easement Agreement and Temporary Easement
Agreement between Crossroad Ford, LTD and the City of Waterloo, Iowa for the hereinafter
described parcels, is accepted and approved and the Mayor and City Clerk are authorized and
directed to execute said documents on behalf of the City of Waterloo, Iowa.
DESCRIPTION: PERMANENT EASEMENT PROJECT PARCEL LPR120
A PARCEL OF LAND SITUATED IN PART OF THE NORTHEAST
FRACTIONAL 1/4 OF SECTION 2, TOWNSHIP 88 NORTH, RANGE 13
WEST OF THE 5TH P.M., CITY OF WATERLOO, COUNTY OF BLACK
HAWK, STATE OF IOWA, MORE PARTICULARLY DESCRIBED AS
FOLLOWS:
COMMENCING AT THE WESTERLY MOST CORNER OF LOT 21 OF
MURPHY SUBDIVISION; THENCE NORTH 54°56'48" EAST (ASSUMED
BEARING FOR THE PURPOSE OF THIS DESCRIPTION) ALONG THE
NORTHWESTERLY LINE OF SAID LOT 21, A DISTANCE OF 179.30 FEET
TO THE POINT OF BEGINNING; THENCE NORTH 47°52'04" EAST, 106.04
FEET TO THE PRESENT SOUTHWESTERLY RIGHT-OF-WAY LINE OF
U.S. HIGHWAY 218 (WASHINGTON STREET), ALSO BEING THE EAST
LINE OF THE NORTHEAST FRACTIONAL 1/4 OF SAID SECTION 2;
THENCE SOUTH 00°11'07" WEST ALONG THE PRESENT
SOUTHWESTERLY RIGHT-OF-WAY LINE OF U.S. HIGHWAY 218
(WASHINGTON STREET), ALSO BEING THE EAST LINE OF THE
NORTHEAST FRACTIONAL 1/4 OF SAID SECTION 2, A DISTANCE OF
16.00 FEET TO THE NORTHWESTERLY LINE OF SAID LOT 21; THENCE
SOUTH 54°56'48" WEST ALONG THE NORTHWESTERLY LINE OF SAID
LOT 21, A DISTANCE OF 96.00 FEET TO THE POINT OF BEGINNING.
CONTAINING 627 SQUARE FEET
TEMPORARY EASEMENT DESCRIPTION:
A TEMPORARY EASEMENT FOR PURPOSES RELATING TO THE
CONSTRUCTION OF THE IMPROVEMENTS IN, TO, UPON, OVER,
