HomeMy WebLinkAbout2010-836-9 /13/2010i RESOLUTION NO. 2010-836 RESOLUTION AUTHORIZING THE SALE AND CONVEYANCE OF 4,600 SQUARE FEET OF CITY -OWNED PROPERTY GENERALLY LOCATED AT THE NORTHEAST CORNER OF VINTON AND FRANKLIN STREETS FOR $1,150.00, PLUS COSTS, AND AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE AND DELIVER DEED FOR SAME. WHEREAS, the City of Waterloo, Iowa, is the owner of real property in the City of Waterloo, Iowa, as described below, and WHEREAS, an offer to purchase said certain parcels of real property in the sum of $1,150.00, plus costs, has been made by Shane Feltz, and WHEREAS, a public hearing was held on September 7, 2010, at 5:30 p.m. in the Council Chambers in City Hall, Waterloo, Iowa, as provided by law, by the Council of the City of Waterloo, Iowa, on the proposal to sell and convey premises owned by the City of Waterloo, Iowa, to Shane Feltz, and WHEREAS, it is the opinion of this Council that sale and conveyance should be made as proposed. NOW, THEREFORE, IT IS HEREBY RESOLVED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA, AS FOLLOWS: 1. The following described real property, as fully described in the published notice in the Waterloo Courier on August 30, 2010, is not presently needed and will not be needed in the foreseeable future for municipal purposes and its ownership is serving no municipal purpose, and 2. That the offer of Shane Feltz to purchase real property for the sum of $1,150.00, and costs, be and it is hereby accepted for real property described below: A survey of that part of Lot 13 in Block 3 of Zollinger's Addition to the City of Waterloo, Black Hawk County, State of Iowa, more particularly as follows: Commencing at the Northeast Corner of said Lot 13 as platted; thence S00001133"E 40.00 feet, along said East line of Lot 13, to the point of beginning of this description; thence continuing S00001133"E 89.51 feet, to a point on the current North right of way line of Franklin Street, said point is 11.0 feet North of the platted Southeast corner of said Lot 13; thence N8904111611W 24.85 feet, along said the current North right of way line of Franklin Street to a point; thence Northwesterly 11.93 feet along 30.0 foot radius curve, concave Northeasterly, with a long chord bearing N7801713911W 11.85 feet; thence N00015151"E 14.63 feet to a point; thence N89044109"W 15.39 feet to a point; thence Northwesterly 12.74 feet along 30.0 foot radius curve, concave Northeasterly, with a long chord bearing N13°10' 12"W 12.65 feet to a point on the current East right of way line of Vinton Street, said point lying 1.0 feet East of the current edge of sidewalk; thence NO100710011W 60.37 feet, along said the current East right of way line of Vinton Street, being parallel to and 1.0 feet normally distant from the current edge of sidewalk, to a point 40.00 feet from the North line of Resolution No. 2010-836 Page 2 said Lot 13; thence S89035112"E 55.82 feet along a line parallel to and 40.0 feet normally distant from said North line of Lot 13, to the point of beginning, containing 4,600.4 square feet, or 0.106 acres, all in the City of Waterloo, Black Hawk County, Iowa; for $1,150.00, plus costs. 3. That the City of Waterloo, Iowa, convey said parcels of real property to Shane Feltz by deed. 4. That the Mayor and City Clerk are hereby authorized to execute and deliver deed to Shane Feltz. 5. That the original of said deed fully executed and acknowledged is hereby approved and confirmed by the Council. 6. That the City Clerk is authorized and directed to deliver said deed of conveyance to Shane Feltz upon receipt of the sum of $1,150.00, and costs.
