RESOLUTION BY THE CITY COUNCIL OF THE CITY OF WATERLOO, IOWA,
WATERLOO HOUSING AUTHORITY , APPROVING THE EXECUTIVE DIRECTOR'S
COMMENTS ON PROPOSED RULE 24 CFR PART 882 AND AUTHORIZING HIM
TO SEEK CONGRESSIONAL SUPPORT FOR THE PURPOSE OF AMENDING THE
NATIONAL HOUSING ACT.
WHEREAS, the U. S. Department of Housing and Urban Development has proposed
to change 24 CFR Part 882 to require the Waterloo Housing Authority and all other
Public Housing Agencies to be solely responsible for the service of Notices to
Vacate under the Section 8 Existing Housing Assistance Payments Program; and,
WHEREAS, the imposition of this responsibility carries with it potential
liabilities with no clear benefits to the Authority, program owners or program
participants:. and,
WHEREAS, HUD proposed the rule pursuant to a California Supreme Court
ruling upholding Section 8(d) (1) (B) of the National Housing Act,
NOW THEREFORE BE IT RESOLVED by the City Council of the City of Waterloo,
Iowa, that:
1. The attached comments dated December n, 1980 on the proposed rule
are hereby adopted as the official position of the Waterloo Housing
Authority.
2. The Executive Director is directed to forward this Resolution and
attachments to Senator Roger Jensen, Senator-Elect Charles Grassley, •
and Congressman-Elect Cooper Evans, and to petition -tor their support
of legislation to appropriately amend the National Housing Act,
