AND THE LLOYD KREGER ESTATE FOR $1 , 582 . 72 PLUS COSTS AND AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE AND DELIVER A DEED FOR SAME . WHEREAS , the City of Waterloo , Iowa, is the owner of real property in the City of Waterloo , Iowa, as described below, and WHEREAS , an offer to purchase said certain parcel of real property in the sum of $1 , 582 . 72 plus costs , has been made by B . Schultz & Co . and The Lloyd Kreger Estate, and WHEREAS , a public hearing was held on December 17 , 1979 at 7 : 00 P .M. in the Council Chambers in City Hall, Waterloo , Iowa, as provided by law, by the Council of the City of Waterloo , Iowa, on the proposal to sell and convey premises owned by the City of Waterloo, Iowa, to B . Schultz & Co . and The Lloyd Kreger Estate , Waterloo , Iowa, and WHEREAS , it is the opinion of this Council that sale and conveyance should be made as proposed. NOW, THEREFORE , IT IS HEREBY RESOLVED BY THE COUNCIL OF THE CITY OF WATERLOO , IOWA, AS FOLLOWS : 1 . The following described real property, as fully described in the published notice in the Waterloo Courier on December 7 , 1979 , is not presently needed and will not be needed in the foreseeable future for municipal purposes and its ownership in serving no municipal purpose , and 2 . That the offer of B . Schultz & Co . and The Lloyd Kreger Estate to purchase real property for the sum of one thousand five hundred eighty two dollars and seventy two cents ($1 , 582 . 72) and costs be , and it is hereby accepted for real property described below: A part of the Southwest Quarter of the Northeast Quarter of Section 14, Township 89 North, Range 13 West of the 5th P.M. in Black Hawk County described as beginning at a point on the North line of Litchfield Avenue which is 707 . 5 feet South and 131 . 2 feet West of the Northeast corner of the Southwest Quarter of the Northeast Quarter at said Section 14 and running thence West 546 . 8 feet along the North line of Litchfield Avenue , thence South 29 feet to the South line of Litchfield Avenue , thence East 546 .8 feet along the South line of Litchfield Avenue , thence North 29 feet to the place of beginning. with the City' s retention of a utility easement over, under, and upon the following described area: A part of the Southwest Quarter of the Northeast Quarter of Section 14, Township 89 North, Range 13 West of the 5th P.M. in Black Hawk County described as beginning at a point on the North line of Litchfield Avenue which is 707 . 5 feet South and 131 . 2 feet West of the Northeast corner of the Southwest Quarter of the Northeast Quarter of said Section 14 and running thence West 176 feet along the North line of Litchfield Avenue thence South 16 feet , thence East 176 feet , thence North 16 feet to the place of beginning. 3 . That the City of Waterloo, Iowa, convey said parcels of real property to B . Schultz & Co . and The Lloyd Kreger Estate by Quit Claim Deed, the form of which is hereto attached and approved. -2- 4. That the Mayor and City Clerk are hereby authorized to execute and deliver deeds to B. Schultz & Co. and The Lloyd Kreger Estate . 5 . That the original of said deeds fully executed and acknowledged having been submitted with this Resolution, the same is hereby approved and confirmed by the Council . 6 . That the City Clerk is authorized and directed to deliver said deeds of conveyance to B. Schultz & Co . and The Lloyd Kreger Estate . Passed and adopted this 7th day of January, 1980 . Leo P.
