Marynette Harris died 12/8/05. . 2. A petition was filed for probate on 4/3/07. • 3. The petition listed 2 heirs.The Final Settlement Accounting lists 29 heirs. Exhibit 1. Marynette Harris was deeded property to her by her parents.She promised to distribute the property to a trust for the family or distribute the property to her brothers and sisters(her parent's heirs).This was in writing.Attached as Exhibit 2 is a survey she had • done dividing up the property for each family. She was going to put pieces of paper in • the hat and everyone picks one. Then she wasgoing to deed the property to them. • • She died before she could accomplish her.task.There is also an affidavit in the probate • file to that effect.There are multiple references in the probate file to the.original family • agreement.These family members are necessary parties and entitled to notice of the • sale and notice of the-final report. • • 4. Stacy Roberts wrote a letter to the court(Exhibit 5)of his concern the heirs would be debunked of their rights. .After this.letter was filed he should have been notified of all • proceedings. • • 5. Stacy Roberts is the son of Aaron Roberts who IS deceased.This would mean his share is to be distributed to his children.This would make Stacy Roberts an heir. He was also in possession of some of the property and was not given proper notice to vacate the land. Stacy Roberts wrote a letter to the Court trying to explain the situation.At the very least he should have been on the list to receive notification of any Court processes. 6. Property was sold in the estate for substantially under the fair marketvalue without notice or consent to all the heirs. It was sold for$2860.00 per Acre in 2016. A print out of the property sold in Buchanan in 2016 Ranges from $5621 per acre to $14,500 per acre for ag land,_Exhibit 3.This sale should be rescinded, 7. The trees on the land were worth a considerable amount and could have been harvested. 8. Executor could have auctioned the land or used a realtor to sell the land. 9. The family settlement agreement was not signed by all the heirs. 10. The property had CRP income from 2000 to the sale of the.property in 2016. There has never been an accounting of that income. The final report was not approved by all the heirs. 11. In one case the final report stated Charles Roberts should receive a check for $21,853.20, he received a check for$20,758.56. Exhibit 4. 12. The final report lists Hertz Farm Management had an appraisal done for$900.00. We requested Fiertz to provide an appraisal and they stated they did not do an appraisal on the property. 13. The heirs did not know the property was sold, didn't even know it was for sale and because of this process lost their rights of appealing the decision to sell. WHEREFORE, we request that the estate be reopened, and Stacy Roberts be appointed as administrator. We request an accurate accounting be done. The sale of the property be rescinded and resold.
