AN AMENDMENT TO ORDINANCE NO. 5079, AS
AMENDED, CITY OF WATERLOO ZONING ORDINANCE,
BY AMENDING THE OFFICIAL ZONING MAP REFERRED
TO IN SECTION 10-4-4, APPROVING A REQUEST BY FALL
AUTO, LLC, TO REZONE APPROXIMATELY 1.81 ACRES
FROM "C-2" COMMERCIAL DISTRICT TO "C-2,C-Z"
CONDITIONAL ZONING DISTRICT, TO ALLOW FOR AN
AUTO REPAIR FACILITY WITH INCIDENTAL AUTO
SALES, LOCATED AT 2424 FALLS AVENUE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WATERLOO,
IOWA AS FOLLOWS:
That the request of Fall Auto, LLC, to amend the official zoning map referred to in
Section 10-4-4 of Ordinance No. 5079 as amended, City of Waterloo Zoning Ordinance to
rezone approximately 1.81 acres from "C-2" Commercial District to "C-2,C-Z" Conditional
Zoning District, to allow for an auto repair facility with incidental auto sales, located at 2424
Falls Avenue, and legally described as follows:
A PART OF THE SOUTHEAST QUARTER OF THE SOUTHEAST QUATER
OF SECTION 21, TOWNSHIP 89 NORTH, RANGE 13 WEST OF THE 5TH
P.M., IN THE CITY OF WATERLOO, BLACK HAWK COUNTY, IOWA,
DESCRIBED AS FOLLOWS:
COMMENCING AT A POINT ON THE NORTH LINE OF THE WATERLOO
AND CEDAR FALLS ROAD, NOW KNOWN AS FALLS AVENUE, THAT IS
40 FEET WEST OF THE EAST LINE OF SAID SECTION (MEASURED AT
RIGHT ANGLES THERETO); THENCE WEST ALONG THE NORTH LINE
OF SAID ROAD A DISTANCE OF 165 FEET TO THE PLACE OF
BEGINNING; THENCE CONTINUING WEST ALONG THE NORTH LINE
OF SAID ROAD A DISTANCE OF 225.5 FEET; THENCE NORTH
PARALLEL WITH THE EAST LINE OF SAID SECTION A DISTANCE OF
264 FEET; THENCE EAST PARALLEL WITH THE NORTH LINE OF SAID
ROAD, A DISTANCE OF 225.5 FEET; THENCE SOUTH PARALLEL WITH
