AGREEMENT OF DONEE
As a condition to a total grant of thirty-seven thousand eight hundred dollars ($37,800.00) from
The R.J. McElroy Trust to Waterloo Center for the Arts - Youth Pavilion for the
Experiencing the Youth Pavilion: Bussing for Student Field Trips, the undersigned
agrees:
i) That the amount of the grant will be payable as follows:
You will receive payments of$12,600 a year for 3 years, beginning in October, 2007.
2) To submit an annual report on what has been accomplished in this program. The annual
report form will be provided by the McElroy Trust and will include the date it is due. The
report will include a complete statement of how the grant was spent, the number of young
people served, and the objectives accomplished by the project.
3) To use funds only for the purposes designated and not to use the funds for any
purposes prohibited by law, including those purposes designated in Section 4945 of the
Internal Revenue Code.
4) To repay any portion of the grant which is not used for the designated purposes.
5) To permit the McElroy Trust, at its request, to have complete access to the grantee's files
and records for the purpose of making such financial audits, verifications, and
investigations as it deems necessary concerning the grant.
6) To give the McElroy Trust ninety days prior written notice if there is a change in status as
a tax-exempt organization as recognized by the determination letter from the Internal
Revenue Service.
7) Not to amend the Articles of Incorporation nor to do anything that is inconsistent with
the charitable purposes contained in the Articles of Incorporation.
8) That the total amount of this grant or any payment thereof may be discontinued,
modified, or withheld at any time when, in the judgment of the McElroy Trust, such
action is necessary to comply with the requirements of the law.
