HomeMy WebLinkAboutWaterloo Development Corporation-Amendment #3 Landscape Agreement-09.10.2007 9-/o -o 7 AMENDMENT #3 TO AGREEMENT BETWEEN CLIENT AND LANDSCAPE ARCHITECT In accordance with the agreement dated April 25, 2006 between the following parties: CLIENT: Waterloo Development Corporation and the City of Waterloo LANDSCAPE ARCHITECT: Craig Ri1:land Landscape Architects (CRLA) for the following PROJECT: WATERLOO EXPOSITION GROUNDS, PHASE I Authorization is requested to proceed with the following additional services: I. PROJECT DESCRIPTION This proposal is for Construction Related Services in assisting the WDC and City of Waterloo with the construction of the RiverLoop Exposition Plaza, Phase I (City of Waterloo Contract No. 721). This project includes construction of tower structures, parking lots, sidewalks, brick paver plaza areas, site lighting and amenities, including benches, fencing, banner features, irrigation, and landscaping. II. SCOPE OF SERVICES Services to be provided under this supplemental agreement, Amendment#3, include shop drawing review, field review, material testing, contract administration and construction staking during the construction phase of the project. The scope of services is further defined by the following tasks: Task 1. Conduct a preconstruction conference attended by representatives of the Contractor, Subcontractors, Client, Consu'tants, and affected utilities. Task 2. Review shop drawings and other submittals as required of the Contractor by the contract documents for conformance with the design concept of the project and compliance with the information given in the contract documents. Task 3. Answer design interpretation questions from the Client, Contractor, review staff and appropriate agencies. Task 4. Review contractor's payment applications to determine if the amount of work represented as complete is generally consistent with the Landscape Architect's observations during its site visits. Landscape Architect's review shall be subject to any noted qualifications by the Landscape Architect. Landscape Architect's review shall not be a representation that Landscape Architect has supervised the work, or that Landscape Architect has reviewed how or for what purpose contractor has used or intends to use Owner's payments Task 5, Perform construction site visits at appropriate stages of construction to review the quality of the work and to determine whether the work conforms to the contract documents. Although the Landscape Architect or its consultant may observe and discuss potential problems, these visits are not construction inspections or a guarantee that there will not be construction deficiencies. Staffing requirements may be adjusted during the project in relation to the level of construction activity. The estimated level of service is based on an anticipated 22 weeks of construction activity by the Contractor. Task 6. Prepare and assist the Client and Contractor in preparing and processing contract change orders. Task 7. Provide periodic field observation during construction to review the work of the Contractor to determine if the work is proceeding in general accordance with the contract documents and that completed work appears to conform to the contract documents. Task 8. Report to the Client any work believed to be unsatisfactory, faulty or defective or does not conform to the contract documents, and advise the Client of any work that should be corrected or rejected. Task 9. Review required contractor submittals, such as shop drawings and samples, for conformance with project drawings and specifications. Consider and evaluate Contractor's suggestions for modifications and report them with recommendations to the Client. Task 10. Participate in a review of the project with the Client and review staff near completion and prepare a list of items to be completed or corrected. Task 11. Participate in a field observation of the completed project with the Client and review staff before a final application for payment is processed for the Contractor. Task 12. Maintain files for correspondence, reports of the job conferences, shop drawings and sample submissions, reproductions of original contract documents including addenda, change orders, field modifications, and additional drawings issued subsequent to the execution of the contract, Engineer clarifications and interpretations of the contract documents, progress reports and other project-related documents. Task 13. Provide the Client with a copy of revised drawings of the construction plans (record drawings) for the project based on the construction observation records of the field review staff and the Contractor showing those changes made during construction considered significant. Task 14. Assist the Client with the final close-out documentation from the Contractor. Task 15. Provide construction-staking for horizontal and vertical controls for the project as follows: a. Project Control b. Mark Removals c. Set Staking Points as Shown on Sheets C-5.4 to C-5.11 for Grading d. Set Stakes for Storm Sewer and Subdrains as Shown on C-4.2 and C-4.3 e. Set Stakes for Light Poles as Shown on Sheet E-2.1 f. Set Stakes for Sign Towers, Light Towers and Fountains as Shown on Sheets A-0.1 and A-0.2 g. Set Stakes for PCC Curbs, Sidewalks, Drives and Parking Lots as Shown on Sheets C-5.4 to C-5.11 h. Set Stakes for Fence as Shown on Sheets L-4.1 and L-4.2 Office Work III. COMPENSATION Based upon the above expanded scope of work and services anticipated, Craig Ritland Landscape Architects (and their subconsultants)will provide the services described above, and in accordance with the conditions outlined in our contract, for a sum not to exceed $159,000. Field Review, Material Testing and Contract Administration (Tasks 1-14) $129,000.00 Construction Staking (Task 15) $30,000.00 IV. In all other aspects, the obligations of the Landscape Architect and Client shall remain as specified in the Agreement dated April 25, 2006.
