Fifty (50) feet of Lot Fourteen(14) in Block Eleven (11), in North Addition, Waterloo, Black Hawk County,
Iowa.

We, Timothy J. Hurley and Nancy Eckert, being first duly sworn under oath depose and state that we are
the Mayor and City Clerk, respectively, of the City of Waterloo, Iowa, the purchaser of the real estate
described above. The purchaser has relied upon the Affidavit from David D. Dunakey, as Trustee of the
David D. Dunakey Profit Sharing Plan, dated September 5, 2007. The purchaser has no notice or
knowledge of any adverse claims arising out of the execution and recording of the deed from the trustee. This
Affidavit is given to establish reliance on the Affidavit referred to above for all purposes contemplated under
Iowa Code Section 614.14.

sworn, did say that they are the Mayor and City Clerk, respectively, of the City of Waterloo, Iowa; that the seal affixed to the
foregoing instrument is the corporate seal of the corporation, and that the instrument was signed and sealed on behalf of the
corporation by authority of its City Council as contained in the Resolution adopted by the City Council, under Council Action No.
of the City Council on the day of , 20 , and that Timothy J. Hurley
and Nancy Eckert acknowledged the execution of the instrument to be their voluntary act and deed and the voluntary act and deed

WARRANTY DEED
For the consideration of One and no/100 Dollar(s) and other valuable
consideration, David D. Dunakey, Trustee of the David D. Dunakey Profit Sharing Plan does
hereby Convey to City of Waterloo the following described real estate in Black Hawk County,
Iowa:
The West Ten(10)feet of the North Fifty(50)feet of Lot Thirteen (13)in Block
Eleven (11), and the North Fifty (50) feet of Lot Fourteen (14) in Block Eleven
(11), in North Addition, Waterloo, Black Hawk County, Iowa.
Subject to easements, restrictions, covenants, ordinances and limited access
provisions of record.
Consideration less than $500.00.
Grantor does Hereby Covenant with grantees, and successors in interest, that grantor holds
the real estate by title in fee simple;that it has good and lawful authority to sell and Convey the real
estate; that the real estate is free and clear of all liens and encumbrances except as may be above
st rated; and grultor Covenants to Warr'int and Defend the real estate against the lawful claims of all
persons except as may be above stated.
Words and phrases herein, including acknowledgment hereof, shall be construed as in the
singular or plural number, and as masculine or feminine gender, according to the context.
