HomeMy WebLinkAboutBlack Hawk County-Electrrical Licensing Agreement-12.17.2007 CONTRACTUAL AGREEMENT FOR ELECTRICAL LICENSING AND INSPECTIONS The parties to the Agreement are the City of Waterloo, Iowa, Building Department (hereinafter referred to as "City") and Black Hawk County, Iowa(hereinafter referred to as "County"). This Agreement is effective from and after the 1ST day of January 2008. RECITALS WHEREAS, City and County are public agencies, and WHEREAS, County desires to engage the services of City to furnish technical and professional assistance for electrical licensing and inspections; and City has indicated its willingness to provide such technical and professional services to County; NOW, THEREFORE, the parties mutually agree as follows: 1. SCOPE OF CITY SERVICES. City agrees to perform in a good, professional manner the services required for electrical licensing and inspection within the unincorporated county limits of the County. Electrical licensing and inspection services will be provided on an "as needed"basis Monday through Friday during normal business hours. After-hour inspections (any time other than Monday through Friday during normal business hours) will be conducted upon special request for the surcharge of$45.00 per inspection. All reports and records concerning electrical licensing and inspections shall be kept in the office of the City of Waterloo Building Department. Licensing and inspections will be provided for compliance with the National Electrical Code (NEC) 2008 edition and any amendments thereto; the June 29, 2000 addition of Chapter 11, of the code of Ordinances of the City of Waterloo, Iowa. (Electrical Code) The Building Department (office and field) shall provide sufficient written documentation of all transactions in order to permit adequate record keeping for such electrical licenses and inspections. 1 a. Licensing: City of Waterloo licenses for Electrical Contractor's, Master Electrician, Journeyman Electrician, Appliance Contractor's, Master Appliance Wireman and Appliance Wireman's shall be accepted as Black Hawk County Electrical licenses under the scope of this agreement. lb. Inspection: Electrical inspection performed in unincorporated Black Hawk County shall be valid when preformed by a City of Waterloo employee employed for the express purpose of performing electrical inspections for the Waterloo Building Department shall be valid inspection when performed under the scope of this agreement. 2. MATERIALS TO BE PROVIDED BY COUNTY. In the event that any information date, re ports, records, and maps exist and are available to County, which may be useful for City's carrying out the services of this Agreement, these materials shall be promptly furnished to City without cost or expense to it. City and its inspectors will provide all equipment and tools needed by them to process all licenses and make the required inspections. 3. MEETINGS AND REPORTS. Upon reasonable notice to be given not less than seventy-two (72) hours, City agrees to attend meetings with the County Board of Supervisors and staff during the life of this Agreement. In addition, City will produce reports, studies, and memoranda in connection with carrying out the services outlined in this Agreement. 4. SUBCONTRACTORS. City may elect to use subcontractors to perform certain portions of the services. City shall remain responsible for all services. 5. CHANGES. Any changes in this Agreement, including Scope of City Services, and any modification of the amount of compensation, shall be first mutually agreed upon by County and City and incorporated into a written amendment. 6. COMPENSATION AND PAYMENT METHOD. County shall pay to City, for services rendered, on a monthly basis, in accordance to the hourly rate plus benefits for each specific employee performing said task and mileage as outlined in the attached Exhibit"A," within thirty (30) days after having received an invoice, which sets forth the itemized statement of the hours accrued by each employee, mileage recorded for all inspections and administrative cost. 7. TIME OF PERFORMANCE AND DELAYS BEYOND CITY'S CONTROL. The services of City shall begin upon receipt of an executed copy of this Agreement, and shall, except for causes beyond City's control, be completed in a timely manner. City shall establish a voice mail box in order that persons desiring inspections may call directly to City and leave a message requesting inspection on Monday through Friday during normal business working hours. If special arrangements are required for inspections at times other than Monday through Friday during normal business working hours, then a surcharge will be added as outlined in paragraph (1) of this document. 8. NON-DISCRIMINATION. For purposes of this Agreement and the delivery of services by City, City agrees not to discriminate by reason of age, race, religion, color, sex, natural origin, or handicap. 9. NOTICES. All notices, communication, and/or demands given pursuant hereto shall be in writing and shall be deemed sufficient if sent by certified mail, return receipt requested, addressed as follows: Building Official/Designee Black Hawk County Building Department Black Hawk County, Iowa City of Waterloo 316 E. 5th Street 715 Mulberry Street Waterloo, Iowa 50703 Waterloo, IA 50703 The date of mailing shall be deemed the date of service. Either party may change the address for notice by the aforesaid procedure. 10. ENTIRE AGREEMENT. This Agreement and the manner expressly referred to herein constitute the entire agreement between the parties. No representations, warranties, undertakings, or promises have been made by either party hereto unless expressly stated herein. All amendments hereto, if any, shall be in writing and executed by the parties. 11. TERMINATION OF AGREEMENT. This Agreement may be terminated by either party upon at least thirty (30) day written notice, except as stated in paragraph 12. In the event of termination, City shall be compensated for all services performed to termination date, together with reimbursable expenses then due. 12. DURATION. This Agreement shall last for the duration of the electrical licensing cycle. This 24 month period shall began January 1, 2008 and run through December 31, 2009. Sixty (60) days before the end of this agreement the affected parties of this agreement shall discuss terms for a new 24 month agreement beginning January 1, 2010. The termination of this agreement will follow procedure as set out in paragraph 11 above. 13. SEPARATE ORGANIZATION. No separate organization is foiined or contemplated by this Agreement. 14. PURPOSE. The purpose of this Agreement is to provide Electrical Licensing and Inspections services to County. No separate financing vehicle or method is used, except for purchase of said services from County, as set out in paragraph 6 of this Agreement. 15. DISPOSITION OF PROPERTY. The parties do not anticipate that there will be joint ownership of any property; and if the Agreement is terminated pursuant to the provisions of paragraph 11, each party shall retain in its control that property that it brought into the Agreement. 16. ADMINISTRATION. The City Building Official or his designee shall administer this program for the mutual benefit of the City and County. 17. METHOD OF HOLDING PROPERTY. The parties do not contemplate that there will be joint ownership of any property, and each party shall retain its own personal property. There shall be no real estate purchased pursuant to this Agreement. IN WITNESS WHEREOF, County and City have executed and delivered this Agreement on the date first above written.
