ADDENDUM
This addendum is signed and entered herein by both parties of the original Temporary
Construction Easement Agreement entered into on April 20, 2007 by and between
SHARON SPEARS AND TERRI DAVIS (629 WEST DONALD STREET), and THE
CITY OF WATERLOO.
Whereas, the City of Waterloo will offer a compensation amount of$1270.69 ($472.75
for one, 32" Diameter Sugar Maple Tree, and $797.94 for 13 Siberian Elm Trees with an
average value of$61.38)for trees to be removed from the property at 629 West Donald
Street for the construction of the Donald Street Recreational Trail, and
Whereas, an additional $400.00 is being added to the compensation amount of
$1270.69, for a total amount of$1670.69, for the additional loss of trees that are not
proposed for removal due to construction issues and potential root damage, and
Whereas, the City of Waterloo will extend an 8' recreational trail in front of the property
at 629 West Donald Street, and
Whereas, a temporary construction easement is needed to insure that appropriate
grading is done into the private property for a maintainable slope, and to do so, 14 trees
will have to be removed
Now Therefore, the City of Waterloo and Sharon Spears and Terri Davis do hereby
agree that the original Temporary Construction Easement Agreement of April 20, 2007,
is hereby amended as stated above.
This addendum shall inure to the benefit of and be binding upon the successors and
assigns of the parties.
