Etringer and Lucile M. Etringer, husband and wife. Tenant: That Landlord hereby lets to Tenant, and Tenant hereby leases from Landlord, the following described premises situated in Black Hawk County, Iowa, to-wit: House, garage and surrounding grounds (except land under cultivation) at 2375 Independence Avenue, Waterloo. hereinafter referred to as the"dwelling unit", in consideration of the mutual promises of the parties herein, and upon the following terms, provisions and conditions: 1.TERM. USE-ABSENCES. Unless otherwise agreed in writing, Tenant shall occupy and use the above-described property as a dwelling unit. Tenant shall notify Landlord of any anticipated extended absence from the premises not later than the first day of the extended absence. 5. MANAGER. Noel Anderson, Community Planning & Development Director whose address is 715 Mulberry Street, Waterloo, TA 50703 is the person designated by Landlord to manage the premises(and to receive and receipt for all notices and demands upon the owner of the premises). 8. MAINTENANCE BY LANDLORD.Landlord sha l: (a) Comply with the requirements of applicable building and housing codes materially affecting health and safety. (b) Make all repairs and do whatever is necessary to put and keep the dwelling unit in a fit and habitable condition. (c) Keep all common areas of the premises in a clean and safe condition, but Landlord shall not be liable for any injury caused by any objects or materials which belong to, or which may have been placed by, a tenant in the common areas of the premises used by Tenant. (d) Maintain in good and safe working order and condition all electrical, plumbing, sanitary, heating, ventilating, air-conditioning, and other facilities and appliances, including elevators,supplied or required to be supplied by Landlord. Etringer and Lucile M. Etringer, husband and wife, as Tenant. A. Notwithstanding any term or provision in this Rental Agreement to the contrary, Tenant will be solely responsible, at its own cost and expense, to care for the premises, including but not limited to all buildings and grounds, and to perform all acts of repair, maintenance, or upkeep that may be necessary. Tenant is also responsible to perform, at its sole cost and expense, all duties set forth in Section 8 of the Rental Agreement. B. The term hereof shall renew automatically on the same terms for any number of additional terms of one year each. Tenant may terminate this Rental Agreement at any time and for any reason upon thirty(30) days advance written notice to Landlord. This Rental Agreement shall be deemed terminated by Tenants upon the death of both of them or upon their moving from the residence without the intent to return within thirty(30) days. In addition to its right to terminate pursuant to Section 15, Landlord may terminate this Rental Agreement at any time and for any reason upon one hundred eighty(180) days advance written notice to Tenant. C. Tenant is advised that Landlord provides no insurance for the benefit of Tenant or its property. Tenant's are solely responsible, at their own cost and expense, to procure whatever insurance they consider necessary or advisable to protect themselves against liability and/or their property against damage or loss. D. This Rental Agreement is subject to approval by the city council of the City of Waterloo, and shall not be legally binding without such approval.
