HomeMy WebLinkAboutIowa DOT-Road Use Agreement-10.20.2008 /6 -?o - 6 r . 0-0 fAIowa Department of Transpo` ation AGREEMENT FOR USE OF LOCAL AGENCY ROADS AS DETOURS This Agreement entered into this day of_ by and between the Iowa Department of Year x City Council Transportation hereinafter known as the Party of the First Part;and the Waterloo ❑ County Board of Supervisors, hereinafter known as Party of the Second Part. WHEREAS,The Party of the First Part has determined the necessity to close US 63 in the 1500 blk.of Logan Ave. (US 63)to accommodate a request from the City of Waterloo to facilitate storm sewer,sanitary sewer,and water main connections for the Logan Middle School. ,and WHEREAS, it is necessary to provide a detour for the primary highway closure period,and WHEREAS,The Party of the Second Part agrees to permit the use of Waterloo local agency roads West Donald Street, Burton Ave,Broadway/Franklin St,Newell, E.4th St.and East Donald St. as a detour,more particularly described as follows: Southbound US 63:Commencing at the intersection of southbound US 63 and West Donald Street,west on West Donald Street approximately 1 mile to the intersection with Burton Ave,thence south on Burton Ave approximately .25 miles to the intersection with Broadway Street, thence southeasterly on Broadway Street and Franklin Street approximately 1.80 miles to the intersection with southbound US 63. Northbound US 63: Commencing at the intersection of US 63 and Newell Ave,east on Newell Ave approximately 0.2 miles to the intersection with E.4th Street,thence north on E. 4`h Street approximately 1 mile to the intersection with E. Donald Street,thence west on E. Donald Street approximately 0.25 miles to the intersection with US 63. , and WHEREAS,Both the Party of the First Part and the Party of the Second Part agree that this detour is to facilitate the work of a contractor performing work for the Waterloo School District, and that the responsibility for any damages to local roads used for this detour shall be resolved between the City and Contractor, Both party's agree to wave writing a report concerning the condition of the proposed detour, and performing a joint inspection of said roads, the subject of the proposed detour; and WHEREAS, Party of the First Part agrees(pre-detour maintenance)supply US 63 route marker signs if available, , and WHEREAS, Party of the Second Part agrees to maintain the detour and provide all traffic control devices required by the Iowa MUTCD including the marking of no-passing zones as specified in Section 3B-5 of the Iowa MUTCD during the period the local agency road(s)and structure(s)are being utilized as a primary road detour and WHEREAS,Both Parties agree that as this detour is to accommodate work being performed at the request of the Party of the Second part,there will be no compensation to the Second Part for excessive traffi:upon the local agency road during the period it was used as a temporary primary road. WHEREAS,The detour period is estimated to begin_ November 3 and end November 21 NOW,THEREFORE,BE IT AGREED that the described road be used as a detour under stipulations outlined above. IN WITNESS WHEREOF,The parties hereto have caused this agreement to be executed by proper officers thereunto duly authorized as of the dates below indicated.
